Hi

A guy at work has just bought an Aprillia MX125. Its 33bhp and he's only got his CBT. I thought you were only allowed up to 14.6bhp. So essentially when de-ristricted you are breaking the law?

Would the police actually check the power out-put if you were to get stopped, or is it quite difficult for them to check?
Can you divert the blame to the dealers as advertising '33bhp learner legal'?

I think what he is doing is a bit cheeky, but he has been doing it for years on RS125's, KMX's etc and never been stopped. Surely the insurance wouldn't be valid.

im on my cbt now and im still riding a fully restricted 125cc, as the insurance would be invalid if you had told them it is restricted to the legal limit and then it turned out to be 33bhp. If an accident happens then the bike is taken away and will be examined to find things like that out.

Hi

It is illegal, but at least 50% of learners do this and it is very rare that anyone ever gets done for it. Highly unlikely to be found in any police inspection following an accident (and even then they are only likely to bother with an inspection if the accident was very severe), and also unlikely that any insurance company would check unless they are really desperate to avoid paying out.

The MX125 is not 33bhp, if it was then yes he would be but it is not 33bhp so he is talking shit probably in an effort to show off. Have a look at this page about the MX125 to confirm it is not 33bhp, assume that they have put 15bhp as a typo instead of 14.6bhp but whatever it is not 33bhp. It will be restricted to be 14.6bhp but it will not be 33bhp if derestricted.

If you were stopped on a big bike (one which is meant to be 33bhp) then they can ask to see proof of restriction or they can if they really want to inspect it but I've never heard of that happening and whan I was stopped by a bike cop and I was riding a ZX6R he was under the impression that was the biggest I could ride until I was 21 so the police know fuck all about it.

If you're on a CBT and got stopped on a 33bhp then it would be easy for them to see as your license will be provisonal so you should only be on a 125 and if it's 33bhp you won't be, it'll be something larger.

You cannot blame the dealer, as the rider it is down to you to ensure that you're road legal.

If he only has his CBT then he is quite legally on an MX125 and if he de-restricts it (it will then make ~20bhp) technically his insurance isn't valid but chances of them ever finding out are 0.

They have the same power output as the RS125. No one cares about the power output of 125's. The only time where you could get in trouble is if you get pulled at 70mph+ and its obvious that your bike is not restricted.

Did the whole derestriction thing myself while I was on me hell plates. Thing was though when it was restricted I could still have got caught doing more than 70 (RS125). Either way would have been bolloxed I suppose!

Can I just point something out here:

If the dealer says its '33bhp legal'
Then it means that its legal to ride on an A1 restricted license.

Its NOT Learner legal and the dealer NEVER said that the bike made 33bhp - just that its legal to ride on a 33bhp license.

I rode mine derestricted on L plates, but tbh I probably wouldn't have it the dealer hadn't delivered it like that, they even put L plates on it.

Few months ago my cousin got knocked off his GSX-R 600 when filtering past traffic by some twat doing a u-turn. The bike was meant to be restricted, of course it wasn't and when I spoke to him I said your knackered, cos he's 21 and I thought the first thing the insurance company would do is be to check the engine, luckily a week later he got a call offering him a payout so he got away with it
