well i just got in and the following story happened 5 mins ago.

i had just decided to go to my dads house to wait for my brother to get home after collage cause he baught halo 2 today. so im all kitted, well just textiles, but anyway, off i go down to the main road and on my way, i eventually get to the roundabout heading into town or round the outskirts and i decide to ride a little so i got round the outskirts till halfway at which i do a 180 at a a favorite roundabout of mine, and come all the way back to the first roundabout and turn left to go into town and to my dads. come round it and straighten up and accelrate to bout 30 when a big 'take the kids to school and do the shopping in' type van pulls into a carpark, right across my path. so i slam on the anchors but im not stopping quick enough, so i do what i was tought not to, and band in both front and back breaks, by instinct and obviously lowside. i jump up, ignoring injuries and my bake, as its not going anywhere, and walk over to the car and start shouting my head off along the lines of you stupid fuckincager, whats the fuckin matter with you are you fuckin blind or something, or did you choose to be ignorant, at which point she(yep, another useless woman) says......and here is the quiz, what did she say?

btw, ive got a limp and a huge bruise, my upper fairing is cracked to shit with my db screen and my mirror is broke, good news, r&g crash protectors work.

a pissed off

If she admitted some kind of guilt you may have her. Try calling your insurers.

Sorry to hear about your crash mate.

I believe that if you have to take evasive action like you did then she is liable for the crash.

I don't think you actually have to hit the other vehicle in order for them to have to pay out on thier insurance.

The insurance claim forms ask 'who do you deem responsible for the accident? or words to that effect...

You were riding along, she pulled out, you were forced to brake heavily or collide with her vehicle - ergo it was her fault.

I would speak to your insurance legal team

FWIW on the test if you force any other vehicle to brake or take avoiding action it's an instant fail.
On that basis it sounds like you've a case for someone pulling out and having to take avoiding action, even if you didn't actually collide with the vehicle.

Best of luck sorting it out.
Hope you and the bike back on the road soon Thumbs Up

Unlucky mate, like demonic69 said tho...sounds like she basically admitted guilt. Get on the dog and bone and let the insurers get the blind bat responcible. How you cant see a light in darkness is beyond me.... probably too busy yappin or checkin her hair .....sexist? or the plain truth......

Sounds like A-pillars claim another victim to me. Chances are that she genuinely didn't see you because your bike was in the blind spot behind the A pillar and was tracked along in it as she pulled out. It is becoming a serious problem and urban assault kiddy wagons are some of the worst for it. There is no excuse for them not being aware of this huge blind-spot but you get this kind of thing every day.

Not like the last woman who did that to me whose first comment after I chased her down for a 'word' was 'you overtook that bus.' which had been about a mile down the road from the junction. So let me get this straight? you saw me a full mile away waited 'till I was nearly there, THEN swung out in front of me.

Why do they always stop completley obstructing the road in those circumstances, chances are that if they had kept going, you could sneak the bike round the back of them? Confused

Sorry to hear that mate - hope you recover quickly!! Thumbs Up

And on the sexism bit - I can openly admit that I (yes, I am female) quite often come out with the phrase "Bloody Women Drivers", 'cause it's true - especially the f*cking 4-wheel drive Biatches!!! Twisted Evil Twisted Evil Twisted Evil

FA, I completely agree with you!

I'm always screaming "Stupid bint", or "you silly blind wench" etc.
I don't think I ever actually check whether the driver is female or not, if they're doing something stupid, I always assume they are female, unless it's a BMW Very Happy

Stinkwheel, I couldn't have put it better myself. She probably really didn't see you, it is still not an excuse, but these big wagons do make their drivers feel very detached from the road around them, and what they cannot see doesn't bother them, so no point in checking blind spots.

Really sorry to hear about the damage V4 Sad Best of luck getting it all fixed up, and if you do choose to try for an insurance claim.

The pillars in my Laguna are quite bad, I think it's also because I feel comfortable in a more reclined seating position, but I do have to make quite a consious effort to look around them.

I love the way people draw diagrams to explain how they've been knocked off. V4's is the first I've actually understood.

Looks like she's 100% in the wrong, I assume you indicated to come off the roundabout? and switched it off before you came to the road she was coming out of?

Hopefully you'll get a nice claim out of her, and get you bike all fixed up.

Unlucky mate.
