The police were out again today pulling over vehicles. Just a document check of course, yea right, only two wheeled vehicles with traffic police going over the bikes and scooters while another checks the documents.

Made a big mistake with me I can tell you. Rude as fuck, wrapped up in his own importance he started off by pulling me over and telling me "switch off SON". BIG BIG mistake. At 49 I think I've earned the right to be called by my name or sir, and I took my lid off and bloody told him so along with the reasons bikers get so anti police is because of tossers like him. I think I stunned him into silence before he sort of apologised and asked the usual questions. One of the other officers checking my bike had a big grin on his face listening to me lay into the yerk especially when I suggested he went on an anger management course to help with his attitude.

After checking my docs he sort of waddled off to the next poor biker in the queue . The real fun bit was the traffic copper who checked my bike came over and said your can is illegal, I didnt argue especially when he said it was worth the fine and producer just to listen to conversation with his oppo. Told me to get on my way and get the can sorted.

A great result for me I think but I would have paid the £30 fine just for the sheer pleasure of bollocking a copper. Age certainly has its advantages.

I did find out a few things from the traffic copper.

They can issue you with a producer without an instant fine where they are not 100% certain about cans etc.

If your can or anything else proves legal you can claim any costs back via the police complaints route.

They were armed with a datatag scanner which did not work. As are most police stations. they get them free but very few police know how they work. Lot of use that one then. £40+ for datatag and the police can use the equipment.

They can refuse to let you continue your journey if they deem the bike to be unroadworthy or illegal. the bike will then be removed by the police and you will have to get a second mortgage to get it back.

I have posted this stuff before but it is worth going over again:

If you are stopped and the coppers start sniffing about your bike.

KNOW YOUR RIGHTS.

especially:

Schedlule 2

of Section 67 of the Road Traffic Act 1988

Basically this says, if the bike is not obviously dangerous (to the point where it should be off the road eg. tyres down to canvas) or has not just been involved in an accident then YOU tell THEM when and where you will allow them to inspect your vehicle 2 to seven days after they stopped you.

I don't have a real problem with these spot checks, with luck they may catch the odd thieving bastard and if I happen to knowingly be riding a bike which has illegal parts then thats my fault and I accept the fine etc.

I'm also sure there are as many rules, regulations and laws which make your post about rights redundant and to be honest I am a biker not a lawyer.

My problem is with attitude, I object to being treated, or spoken to in such a manner that I find offensive by someone who should know better. Being polite costs nothing. Its also some officers attitude that all bikers are breaking the law in some way or another that really pisses me off.

If you're the owner, you have 30 days:

"(a) specify a period of seven days within which the deferred test is to take place, being a period falling within the next thirty days, disregarding any day on which the vehicle is outside Great Britain"

The thing is, if you start going on about no you can't look at my bike, you can look at it in 30 days time then you're likely just to piss them off further. The only real reason you will want the checking of your bike to be done at a later date is because there is something illegal which you want to change, as if it's 100% legit then you're really not going to care if they want to check your tyre threads, look at your exhaust etc etc.

In the same way that if they ask you to get off your bike and you then start mouthing off and getting pissed off/ angry at them then they're likely to get pissed off back and make as much hassle for you as then can. I think there is a fair chance the cop only did you for your illegal can zx636 as you starting argueing with them generally annoying them.

Sorry, but I believe if/when you get pulled over by the police for whatever reason unless you are 100% legal and they couldn't possibly do you for anything then you want to stay clam, polite and practise arse kissing unless you want a range of fines, points, a producer and general hassle.

Maybe I wrote it a bit wrong or it reads incorrect.
In fact the officer let me of and told me to get it sorted, he was expressing that it was worth letting me off just to watch me have a go.
The police checking the bikes were obvious traffic div while the one stopping the bikes was a beat officer.

If we all had the kiss ass attitude then the police would be getting away with everything. Its sometimes the odd one or two who say "no" that make the difference between freedom and a police state.
If you wish to adopt the yes officer no officer attitude that is your right and I would not presume to say you are right or wrong. Sometimes the situation makes normally calm people like me react regardless of the legality of the bike.

I will take whatever fines, hassle etc comes my way as my bike is not 100% legal and I accept that, What I will not accept is someone in a position of trust etc, such as a police officer being rude and intimidating. At my age I dont have to stand for it.

Just one question: what documents was he checking? Do I need to take some insurance documents/license/V5 with my bike everytime I go for a ride?

The REALLY annoying thing about this is that they have NO NEED to do a document check. They already have the databases in place that will tell them who the vehicle belongs to, if they have a licence, wether it has an MOT and if it is taxed (this is what those road-tax cameras use, by cross referencing your optically read registration number with a list of road taxed vehicles then sending a fine to the registered keeper if they are not taxed).

They can have this information in front of them extremely quickly (like they would know before they had pulled you over if they were following you for some reason). In addition, there is also a database that tells them if the vehicle is insured, this is not as extensive but would cover the vast majority of vehicles covered by standard policies.

When you consider the above. Why were they stopping people for a 'Document check' when they are already fully aware of the status of the vehicle and driver by the time they have stopped? If you happened to have no documents on you (which would be the case for most people) I am willing to bet they would have given you a producer for no reason other than to cause you inconvenience.

The documents checked was my license although I did have my insurance with me as well.

From experience I have learnt to carry my license and insurance with me at all times. MOT if needed. It most certainly does save the hassle.

I may be wrong but I believe it is a requirement to carry your license when driving.

As I have said, its no problem being stopped and documents checked, and If I didnt have them then with me then a producer is also OK. A hassle but not the end of the world.
Its the attitude of some officers that gets me mad, nothing else.

Some officers, especially the beat ones and the PANDA drivers have a biker down as some low life before they even pull you. I'm sure they are not all like that but of the three times i have been stopped in the last year, everytime I have got the anti bike brigade.

Legally yes, but it is an acceptable defence to produce them at a specified police station within 7 days.

By the way, never jokingly say you will take them into the station at Lands End or the like. The copper is quite likely to accept that, and then they will only be accepted when you take them to that police station which could be a very long journey.

Recently I was working in the city centre waiting for tiles to be delivered. When the man came with them (fair enough driving up a no cars zone) the first thing the police man said was "Are you f---ing stupid?"

That didn't go down too well.
