IMO, the prosecution will rip him to shreds. As already touched upon, if you're in bed with the other half and you suspect an intruder is in the house, first thing you'd do is wake up your girlfriend. He's asking us to believe that he didn't even look to see if she was there The bloke sounds like a bit of an arsehole to me - legs or no legs.
