Using car parks as tracks:

What's up peeps. Hope you've all been enjoying some sunny blippin! So far I've milked it like a pro dairy since snow disapeared!
Anyways. I bought a new road goer pit bike mid feb (one with engine and frame numbers that actually tally v5!) and have been enjoying some fully insured 5 minute blasts into town and about my suburbs on the little 125, when I discovered that a hardly used car park near me has a perfect figure 8 that suits the stomp just grand.. See attached.

I was wondering if any of you perhaps know what laws i am breaking if I spend all summer there putting down times with my lap timer phone app.
There's never more than 3 cars every time I've been there. Never seen as many as pictured. Odd pedestrian that i slowed for. No posted speed limit. Street lit area. I just blip 30 on the back straight as I've geared the bike for top speed. Am I looking at jail or a slapped wrist for continuing lonely knee down bliss?

did a search on the laws of car parks and didnt come up with much.

P.S. that left hand access is shut, only access to car park is from right of picture. Which isn't finished in picture.

You'll be thrown off before you can say "but..." If the car park is freely accessible from a highway then it is considered to be a road for the purposes of the law. Not only that but the owners will be terrified you'll crash and sue them, so they won't want you there either. The rozzers will turn up before you can say "Driving without due care...".

From the picture it looks like there is a barrier across the road.

If there is then I would try explaining to the manager what you want to do after the barrier is closed... they can only tell you to piss off at the end of the day.

I've used the homebase carpark for throwing an espace around when it was covered in snow, there were customers coming in and out and no one said anything to me

Think I might push my luck at irregular 10min intervals and see how long my fun lasts. If/when plod apperates, i'll try to explain that it's a new bike that I am just trying to get a feel for, apologise and quickly skidaddle.

I think you're being optimistic that you will be able to skedaddle at that point. They'll go over you and the bike with a fine toothed comb, and if they find ANYTHING they don't like, you'd better lube up.

I think you're being optimistic that you will be able to skedaddle at that point. They'll go over you and the bike with a fine toothed comb, and if they find ANYTHING they don't like, you'd better lube up.


They won't find so much as a missing reflector. I know how the authority's view pit bikes. So I made sure this one has nothing to hide, and I carry v5+COMI when I'm on board.

I used mine in a closed Park and Ride once..

That is part of the problem, 'you' can't see any issue with this.

If you have free access then any other member of the Joe Public has equally free access.
Therefore you present a danger to other Joe Publics and will invariably be collared by the PoPo, Security staff or some evil cnut wiv a big stick and thick forearms.

It is not a free world.

My local one stopped a few years back. Its a lovely kart track aswell. Ive pleaded with them to reconsider but they insist that Bikes cause to much damage apparently. Nearest one for me now is bleedin miles away and regularly swamped due to being the only one for bleedin miles.

Do you spend your free time in closed car parks? I'm yet to see anyone, even when I twat around on open roads... usually Sundays are quiet anyway.

Just saying, if I lived there and there was someone gonig round and round on a little bike, even if it was quiet like a go kart, I'd get bored of it pretty quickly.

Everyone is just telling you what to expect, but by all means get down there and try it out and report back on your success/failure/prison cell/hospital bed

Didn't Rogerborg cover that in another thread? From memory (as CBA to search ATM) he argued that the spaces between the parking places were highway but the parking spaces were not. Or something similar. Or opposite. I forget the details Embarassed

On topic FWIW I'd think it pretty antisocial to use as a racetrack. However I would think it an appropriate venue for learner training. Does that make me two-faced? Do I care?

I'm going by case law citations in Blackstone's "Road Policing" Manual (although ironically someone seems to have half inched my copy) that the lanes between the parking spaces have been held to be a "road". But in any case the whole thing is very likely to be a "public place" (being a place to which the public enjoy a general right of access).

In theory, you could be done for trespass if you're asked to sling your hook and don't.

If it's just called in and the rozzers roll up to find you buzzing around an empty part of the car park, then I'd expect an accusation of "inconsiderate" driving, but probably not a prosecution because "A person is to be regarded as driving without reasonable consideration for other persons only if those persons are inconvenienced by his driving". Don't bet your license on that though.

However, the accusation will be a pretext for slapping a Section 59 bike ASBO on you for sure.

Second time, they'll take the bike.
