This is probably not the best way to say hallo to this forum, hallo.

I would be grateful for some advice. I have been riding for about two years, and had my first crash this morning, caused by someone else.
I was riding in North London, filtering to the right of stationary traffic along the broken white lines in the middle of the road, at slow speed. The light conditions were good the road was dry. I was doing no more than 10 mph. All of a sudden a 4x4 turns right to do a turn in the road, a u turn. I try to stop, and move right to avoid but still get knocked of. Thankfully I did not feel damaged, just shook up. Here is the thing, I asked for the drivers details. He gave a name and number, but refused to give insurance details or an address. I thought this was odd, I decided to try to get a picture of him with his car in the road. As I do this he hides his face.

My first worry was weather I had any structural damage to my bike. I took it straight to a motorbike garage. They looked at it and said do not worry its only superficial.
The bung got scratched, The handle bar was very slightly bent, rear indicator hanging, back box scratched, a wing mirror scratched and a rear panel slightly loose.

I have 3rd party insurance with rac. Since the damage is minor, is it worth making a claim? Even though I was not at fault would a claim have an impact on next years policy.

If I do claim is it better to do it through an independent claim company instead of the insurers?
Also should I also report the driver for failing to to provide full details?

I managed also to get the details of a witness.

I was driving a Honda cb600f 2005 hornet.

You have 2 choices.

1. Phone the bloke and tell him to pay for the damage.
If he says no then....

2. Go straight to your insurers and file a claim against him.
If you do the latter, be sure you are 100% in the right.
If you are then it will not wipe out any NCB you have collected over the years.


Addition, did you get the reg number?

The odds are high, since he was so unwilling to provide an address. Also he would not admit liability.

Definitely tell your and insurance and go to a police station and report it. By refusing to give an address the driver has committed a criminal offence.

Do this if for no other reason that to cover your own back.

Did you get the reg number?

And as above, he has committed a crime.
Get on the blower and the popo might be able to find the driver through local CCTV, if any.

Write down everything, do it now! What the driver looked like, what he was wearing, the details of the car, exactly where it happened etc. That way if you do have to contact the police (and I suggest you do that anyway for the reasons that others have already given) you will have a fairly accurate account from your perspective.

If he wouldn't give you an address and insurance details then he has something to hide.

If he refused to give insurance details, I'd have been on the phone to the police there and then. Just incase he gave false details:

Don't phone plod, walk into a nick and report it to someone, they'll probably ask to see your documents anyway. Regardless doing this face to face is a lot safer.

Ok I went to my local police station and was given a form to fill out and bring back. They said no documents required. I suppose they do a computer check as standard.

However there is a section in the form that asked if i was within 50 metres of a zebra crossing. I was about 10metres from the start of the angled broken lines or controlled area.

I wonder if this will have a bearing?

If you weren't within the zigzags you haven't committed an offence.

FWIW I can still remember the registration number of the Volvo who pulled out on me when I was filtering about 5 years ago. I committed it to memory that fiercely.

When you get hit off your bike one of the best things you can do is ask for ambulance to attend to check you over, this way the Police have to attend the accident scene.

Chances are you have been given a fake number and fake name, driver was probably uninsured as well.

Much as we moan about them you should call the old bill out in this situation. If you do this and he drives off he's leaving the scene of an accident which is a prisonable offence.

If someone gives you their number ring it there and then to check it. "No offence mate...... You did just knock me off etc"

Hope it works out okay.

No need to ring the old bill, if you ring them they likely wont attend if you call for Ambulance they have to attend, and statements have to be taken, always call for Ambulance.

There is a possibility the person that caused the accident did NOT have a valid driving license or was already disqualified from before, except the other option possibly driving without insurance and/or current road tax. Another slim chance that he is actually just a common criminal and not wanting to be ID'd by the Police if you showed his picture to the authorities.

Like previous person stated try the phone number and give it to the Police because they can trace the owner of the phone which will help them charge the person for failing to give insurance details to you at the least.

On road accident you must supply your name and address and the name and address of the owner of the vehicle you were using, if it is not your vehicle.

If the guy refused to give you this counts as "Failing to Stop and Report following a Road Traffic Accident" and you can report him to the police.

Failing to stop and report is a criminal offence: Each offence can result in an instant driving ban, but in normal circumstances, you should expect a means tested fine up to £2,500 and between 5 and 10 penalty points. In extremely serious cases, punishment can include community service, a curfew order or a prison sentence.
