Assault charges, pleaded not guilty, confessions on facebook

So, my mother got battered in the pub.

The person is denying the assault and pleaded not guilty but has confessed to it all on Facebook via Private Messages to two separate people.

A little bird has sent me pictures of these conversations, they are cropped to the conversation only but would that stand as evidence in court?

The screenshots alone, I doubt it very much - you could have just signed up accounts under those names and written it yourself.

Facebook will log most things but whether the police care enough to try find the information... well. I'll let you answer that one for yourself.

I doubt the pictures would, but the police can request to view the messages I believe if they request. So if you showed the messages to the police, see where they can take it from there?

There have been quite a few cases where the authorities have followed up and prosecuted motorists that have been indiscreet on 'tnet though I'm not sure that they would bother with something as trivial as assault and battery.

The police must have had enough evidence to charge the assault, so there must be a decent case anyway. If there are independent witnesses, CCTV and similar then he hasn't got much chance of getting out of it.

It's perhaps worth making the police aware of the comments on Facebook because they can apply for data from the account in question. They might not feel it necessary if they have enough evidence anyway, but it's always useful and might encourage a guilty plea if they were to get hold of it and send it to the CPS. Screenshots of the messages won't really do the job as evidence.

Pass it on to the fuzz. They'll tell you to stop getting involved, mind.

Even if a conviction is already a given, it will help give the lie to the fake remorse that'll accompany the plea being changed at the courtroom door.

They do indeed use facebook as a tool for catching 'bad people'. They won't take the pictures as evidence, but im sure if you let them know they can find the messages themselves.

A facebook friend spoke about his deep hatred for the government in private messages and how he would love to 'bomb parliament' smart move...smart move.

been in a case where screenshots were used in Evidence
some PM's and posts were printed off by us to prove the accused had ulterior motives and what he had been doing to manipulate the evidence
in the end that was part of his downfall as he tried to fight the case on line as well as in the court
when it was a live trial I had to be very careful what was posted on our site regarding the trial
he wasn't as astute and got into serious shit for posting court proceedings online

screenshot everything you can and give it to your mums lawyers
Jpg's can be checked to see if they have been altered
but screenshot the full page with your toolbar showing times and the web source (full URL)
