Background - 3ish years ago I got given a £75 fine by a magistrates court. Didn't pay it, kind of forgot about it, what am I like eh.

A few months after the court date I got sent a letter by the court telling me they had issued a warrant for my arrest but that didnt really seem to do anything, so I forgot about it again, boys will be boys etc.

Anyway then nothing, and several house moves and then I got this letter, from a 3rd party bailiffs. I'm not too fussed about normal debt recovery people, I get the joke letters from people after SORN fines and TV licence all the time, but this seems a bit more serious. I will pay it, but I'd like to know where I stand on a few things.

1 - There's no breakdown on how the fee is now £375, but that seems to add up to the 'potential fees' section on the reverse of the letter + the original £75. Any ideas what the £215 'attendance fee' is, I'd really sooner not pay some random number because some random company tells me too. I have a feeling their charges are going to get pretty creative.

2 - This 7 day arbitrary limit. Would make it easier for me to front this on my next payday. What exactly does the 'magistrates court order' do that means they can tell me what to do.

Unless the fine is in regard of a criminal offence or VAT and is of a non-commercial nature (eg, personal, not business) the bailiffs have no right of entry into your home. Which means unless you are actually stupid enough to let them in they have no teeth at all.

Or at least that's my understanding from the govt website.

Wrong.

It's from a certified firm of bailiffs acting on a legitimate court order.

Pay it. Ring them and ask for a breakdown of charges if you like, or ask them if they will accept a payment plan or payment on x date, but if you don't pay it every time they call you or send a letter the fees go up.

There are bailiffs after me, for a parking-fine. I lol at their notices through the door. They were going to take the car (the only thing they could get at) until they discovered it's not mine. We don't answer the door to anyone we don't know or recognize so the bailiffs would need a miracle just to get a "feck orf", never mind an invitation to come in and ponce like the filth they are.

However, OP is clearly a bit... well, lassez faire, and he's unlikely to do more than rack up the "charge for sending you a bill of our charges" tally by ignoring the issue.

Tristan, have you considered going down to the actual court with a bag of money and seeing how little you can pay them to make it go away?

A fair judgement, I'm not quite as bad as I used to be though, plus to be honest I'm in a better position now to pay the £375 than I was then to pay £75, so I'm not too fussed.

The top website gives advice on how to declare myself an independent trademark or some such nonsense. The other recommended site just explained that the £215 fine is within their rights to charge me. Seems pretty clear cut. I'm not looking to wriggle out of this. I just wanted to know exactly where I stood, and now I do.

Rang them up and paid Thumbs Up If I was to carry on thinking about how I could of maybe got out of part of it, or taken it to court to argue it was an unfair charge, or just stonewalled them I would be wasting more effort and emotion than the value of the charge.

Imma carry on not sorning my 9 untaxed bikes though
