10-20 MPH lowside

Pissed off more than anything

Hit pothole (That I have reported before!!!!!) made the back step out and lowsided the bike did a 360 with me under it Laughing

The damage

Scratched brake pedal
Scraped bar end
Snapped foot peg
Possible bent something bike doesn't feel quite right feels dodgy turning left and I can't tell what Crying or Very sad
Ground down pillion peg a bit

Injuries to me

Arm aches and arse hurts but my gear done its job Thumbs Up

So you fell off after hitting a pot hole that you had knowledge of for at least 3 months? Laughing

Seriously, you can try making a claim but if the only person who reported the defect was you then it is likely that they will defend with something along the lines of 'you were aware and should have been more vigilant'.

I think you should have reported it to the local Police so that you have a record of the accident before contacting the council, you were injured weren't you?

Hot weather then rain makes the road greasy, the only reason I crashed is because the pothole made the rear step out and under.

you can't really see the hole in the rain tbh and after 3 months you kind of expect it to be fixed...

if the council have been aware for 3 months and haven't bothered then they should pay for the bike and gear damage. they're the negligent ones.

You were injured in an accident on the public highway. It was what I was told to do when I hit diesel. All the Police did was record the incident but that was enough to move the claim forward.

Hey SQL.

Speak to the Council you reported the pothole to if you have reported the pothole already, especially as you say you've reported the pothole three months ago.

Specifically, see if the pothole is on this site: https://www.fillthathole.org.uk/hazards/map. If you can prove the Council know about the hole, have for a long time and that they haven't fixed it then you could well get compensation for the damage to your motorcycle and gear from the Council responsible for maintaining the road.

I don't really advocate this litigious culture, especially as you've known of the pothole for months and months yet still crashed on it, but it's worth pushing for compensation from the council as it likely get them to fix the darn thing! It's worth thinking about. I'm no lawyer but it's worth a try, people have gotten compensation from Councils due to unfixed potholes in the past.

Entry and exits on the roundabout are single lanes and there are no road markings, what makes you think it's two lanes? Overbanding does not define boundaries.

That roundabout has always been greasy as fuck in the wet, i nearly lowsided my RS125 going round it back in 2003 because someone left half a rug or carpet in the middle of it.

After a while Council admitted full liablity (overwhelming evidence) and paid me out £1250 today for damage to gear and bike Thumbs Up

Don't let them fob you off and push them, also anyone wondering if you can claim push them and it paid off in my case.
