I've got a few days work coming up next month in New York, and was looking through the visa/entry requirements.

The visa waiver looks like it suits me fine, except for this part:

Now, I've had the misfortune to be nicked a couple of times - once for criminal damage (not charged, I was about 14/15, so back in '89/'90), and once for possession of a controlled substance (weed, took a caution, probably '99/'00).

How fucked am I? What are the chances of this showing up on record?

Any BCFers with 'shady' pasts made it in under the visa waiver?

I went in 2006, was the 'waiver' system running then?

Edit. It must have been, otherwise I'd have needed a visa. Duh. Laughing

So yeah, back then they obviously didn't check.

I may be wrong and cannot be arsed to check but I thought that anyway under Visa Waiver you can only be a visitor and cannot work?

You can travel on business on a visa-waiver. I've been to the USA that way for work many times. There's a difference between visiting on business and being employed in the USA. My past is squeaky clean though - I have had to prove it in the past for visiting nukes.

Yeah, that's what worries me. I'll also have to inform my employer as to why I need to apply for a visa, which could potentially be a little embarrassing.

I'd put a fiver on you coasting through immigration without incident as long as your body-language doesn't give you away. But then I can afford to lose a fiver. Of course if you *do* get tugged at the border having made a false declaration on your ESTA you'll not get in this time or possibly ever again.

On the other hand, it's unlikely the US authorities will have any whiff of your faintly chequered past but if you declare it on a visa application you're inconvenienced for life.

I flew to NYC couple of years back, just filled in an ESTA, no other docs, had no troubles. Yes, I have been arrested before.

I would treat this similarly to the Australian WHV one.

They said no one is allowed in with ANY criminal record, and they must have $5k+a flight booked/money to cover it.

But, it turned out later that it was just a declaration. My ex's (Irish) boyfriend got nicked for drink driving, and he had no license, a VERY long previous history in Ireland, and drove to court on the day.

My advice, as others have said essentially... Treat contemptible things with contempt.

I'd say you have next to no worries, and moreover, you can legitimately claim not to remember (13 years ago for a weed caution... fuck me).

If you tell your boss you're a bit sick before you fly, if you get denied and sent back you can simply claim you were too sick to fly. I'd be amazed if you couldn't square it away in their office stateside anyway.

my mate was over there last year climbing in yosemite, he has had loads of arrests in nz, and been done for d.i.c. once, he went straight through with no bother, i wouldnt worry, in general other countries arnt able to access arrest reports from an outside country at the airport,
