Looking at buying a bike, cat b as far as im aware, hpi check says not written off but its obv not updated, where do i stand with a cat b thats only got a scratch on the frame?
Do i need to change the frame or is there any LEGAL way i can use it without having to do that.
Update:
Spoke to dvla.
They said
They can only advise what insurers say and that it SHOULD not be used on the road not must not be.
Also they said they don't get told of a cat b write off's only c + d as they need a vic check.
Why do dvla always insist bikes need a vic test lol.
Advised me to ring insurance and see if they would insure me on a cat b.
Update:
called insurance, passed round the office more times than warpeds tranny girlfriend..
They all said yes its not a problem i can get insurance.
so thats insurance: yes

I've never seen any actual legislation about it. I believe it's all cooked up by insurers and the DVLA, and there's not even a VIC issue for bikes.
Thing is, how would you know a vehicle's been written off? The free DVLA vehicle check and askMID don't tell you, and neither do insurers when you buy a policy. Like heck am I paying them extra for a HPI check, so for all I know, every single one of my (2nd hand) bikes have been written off.
All that said, I wouldn't knowingly touch a cat B simply because of the hassle of dealing with the forces of idiocracy. ____________________ Biking is 1/20th as dangerous as horse riding.

You're correct, you haven't seen any legislation, because none exists, it's just a gentleman's agreement between the insurance industry and the DVLA, ostensibly to reduce the number of 'dangerous' write offs going back on the road.
In theory, a Cat B is a vehicle that is fit only for breaking, with the identifiable part of that vehicle (car shell, bike frame) not able to be reused; the mechanism is meant to be that the VIN is marked on the DVLA database and, when you apply for a V5, your application is denied.
In practice, it seems particularly easy for bikes to slip through the net and there's plenty of Cat B bikes legitimately on the road.
As far as the insurance companies go, it doesn't seem to be that difficult to insure a heavily written off bike, mainly because it only becomes a problem (for the insured) when it gets damaged/written off again.
At that point, the insurance company run a check, discover the bike's history, then use that to leverage a lower pay out, either by claiming the condition of the machine contributed to the accident, or the written off status substantially reduces the value of the bike.
My personal recommendation would be to HPI every bike you intend to buy, but bike owners don't seem to be all that fussed about owning/buying/selling dodgy machinery, so you can treat that recommendation with whatever degree of contempt you feel it deserves. ____________________ Things get better with age; I'm close to being magnificent........

If you can get a V5 in your name ie, you apply to the DVLA for it and get it back, you will be fine, until you claim against your insurance when you smack it up, assuming you didn't tell your insurance company it was a write off.
Even then, it won't be a problem, because you paid so little for the bike in the first place, it won't be worth claiming. ____________________ Things get better with age; I'm close to being magnificent........

Ok home now and done some googling..
So theory is..
apply for v5, dvla say yes then jobs a gooden i can just go straight out and use it?
would i have to take it to be moted or anything?

Expect a visit from the cops. That's what happened to me when I bought a Cat b and applied for the V5. As I'd already bought a 2nd frame (and V5), then they were OK, and actually quite helpful. Nice to have a reference to point to when others ask, at least.
Note that some people have had trouble with various places, but they shouldn't have because, as you've found, there seems to be legal standing for any of it. |

As it's me selling him it, would it be better for him to apply for one separately, so I can destroy mine when he receives his? Or does it not really matter too much?

If it were me, I would send your V5 to the DVLA, informing them of a change of keeper; that is your responsibility and if you don't, it could bite you in the arse later. ____________________ Things get better with age; I'm close to being magnificent........

Not strictly relevant, but certainly related. My Triumph is a Cat C and I had a small amount of the run around from Carol Nash when insuring it, I suspect it was more an idiot in the call centre than anything else mind. I initially got told I'd need to get the bike MOTed and have a VIC check on it, after some confused digging around, another phonecall back comfirmed that actually I wouldn't need either and that they were happy to insure it there and then
Beyond that, my garage confirmed it was Cat C on it's first MOT last month but otherwise it's not even been mentioned. Quite happy with the savings tbh  ____________________ 2010 Triumph 1050 Sprint ST |
