so, I had my first major, I say major, it was quite minor really, accident earlier this week.

usual story, just bumbling along, when out of nowhere a wild granny in her car pulls out of a junction without warning.

probably wrote off the bike, me, relatively undamaged in the grand scheme of things, apart from the way I landed, foot under the bike, me backwards over the top, and yup, snap crackle and pop....

spent the last 4 days in hospital in absolute agony, doped up on copious amounts of morphine.

end result isn't really that bad considering the amount of pain, multiple fractures to both the right lower tibia and fibia, a lot of swelling and bruising etc temporary full leg cast for the next week until everything settles and then its in for final xrays and either another cast if everything gets aligned properly, or surgery to pin my legs, either way its going to end up with a full leg cast,because of the position of the breaks for at least 3 months, its going to be a non load bearing cast, as it is now, so its going to be hopping along for the next 3 months....

plus to top it off, ive literally just started a new job, done a week and this happens, employers are ok with paying ssp for the length of the temporary contract if needed, but it leaves me around £350 down each week.

so im pretty much up shit creek without a paddle.

the police got a full admission that it was all her fault at the scene so its pretty much an open and shut case,if there is such a thing.

now my problem, im only third party fire and theft, so cant palm it off to my insurers to deal with it, so, its either a diy jobbie, which I really dont feel up to right now, considering, or a claims company, so anyone got any recommendations?

Without coming across as being a money grabbing shite, because im not really, but hey, there's a cow there that needs milking, and ill be damned if im not gonna milk the bugger, because, well, my life has literally been turned upside down in a matter of days, I finally thought things were coming together after a while of lets say turbulence and this goes and happens, and chucks a massive spanner in the works, although it could be seen as a blessing in a painful disguise, I can take stock of everything, figure out where im actually going, and possibly bank a couple of quid to kickstart things at the other end.

so anyone got any recommendations on how to move forward with this? because its the first 'major' thing ive been involved with.

FWIW, in my two non-fault accidents that involved other vehicles, I had no difficulty in getting insurance to deal with it - and that was with third party only.

The insurance companies generally contract out the process to claims companies anyway. The last one I dealt with was Plantec, and ironically was the claims company for both my insurance and the third party's insurance.

With your severity of injury, you may be better off going with a motorcycle solicitor, rather than hoping to get lucky with whoever you end up with. Give e.g. White Dalton a try, https://www.whitedalton.co.uk/.

When I got knocked off a year or two ago, the whole process was done by the drivers insurance company.

In fact to this day my insurers at the time don't know I was knocked off (they were useless cunts anyway.)

Definitely get a solicitor who deals with motorcycling accidents. Bear in mind that there may be long term problems resulting from your injuries and don't be tempted to settle for a quick buck. A good solicitor will keep you right anyway and you will be able to include his costs in your claim.

get somebody else to do it for you, when i have my accident i contacted https://www.bldgroup.co.uk/ and they did everything for me, and i did;t have to do anything, they also paid the £150 that the police had charged to recover the bike, was very helpful

her insurance will have to sort your bike so wouldn't worry about that. they may offer to sell it back to you for a low amount if not cat B I think, if so do it as you'll get more breaking the bike and selling than you'll likely pay them for the bike back

Your insurance deal with it anyway, regardless of level of cover. Confused

They'll just assign some no win no fee people. I've heard good things about BLD, but also McAms. I'd give them my business before anyone else.

You are the "third party", in this case, your insurance company will deal with it!

Any thoughts on this letter I've received from LV, the woman's insurers. Is this them admitting liability?

I haven't put in a claim with them, so the woman or police have passed on my details.

It's an insurance company, they're trying to rape you while giving you a nice smile...

This isn't just about damage to your bike this is about damage to you. Who knows what will happen in 10 years after your leg is pinned and suddenly you can't walk or something.

Talk to a proper bike lawyer, take their advice.

Do not settle for just the value of your bike

My last accident was dealt with by BLD, in all honesty I probably wouldn't go with them again, there was nothing wrong as such with the way I was dealt with, but I felt very much like a number being processed the whole time, just another crab in the bucket so to speak.

As for the letter, if you choose somebody to represent you just pass it their way. I guess if you DIY it then just give them a call.

I used Angel Helphire in the past, cost me £10. Nothing else, got a barrister, a solicitor as it went to court. Took 6years but I got a pay-out. Thumbs Up

That's a standard form letter that they send out for a routine bump,


The only thing to do with that is thank them for getting in contact and point out that as you were on a motorcycle and have been badly injured which is preventing you getting to work you are taking advice and will contact them shortly

Essentially keeping them in the loop

be b loody careful.
since april when the law changed on fees claims managers are dealing with this stuff they are not solicitors and are un qualified.

go witha known solicitor who has handled these types of case before
Dan has named one he was happy with , I use Byrne and co in southport have used them twice and they have been brilliant . and no they do not pay fees for introductions that stopped in April 2013 also.

Do not , I would strongly advise, use the people your insurers recomend , they do not have your best interest in mind they are thinking whats best for them all the time. White and Dalton do a lot of Motorcycle claims and have a specialist who deals with cases where the road surface was a factor in the crash . Byrne are just damned good at what they do , Remember claims handlers /managers are interested in getting a settlement quick rather than the amount .....
Ok no armed with this information do not ignore what others have told you , I notice quite often people ask for advice then having been given sound advice they then post up they ignored it completely and went there own sweet way right up the garden path hand in hand with the devil who you just know is going to drown him in the duck pond at the end of the path ...

You don't want a claims management company, they're unnecessary middle men. You want to go to a firm of solicitors who specialize in motorcycle accidents and your specific type of injuries.

As Arry says, not the case.

The OP has 3rd party insurance. That is covering his liability to 3rd parties. In this case he is not the 3rd party to his own insurance. He is the 3rd party to the other drivers insurance, and that is who he is claiming from.
