So had my first crash today, went into the side of what i think ( still waiting for the boys in blue to come with her details) Nissan micra.
My question is, bike is a 1988 CG only damage from what my mate can see who rode it to his is, a broken indicator, foot pegs bent, handle bars bent and he thinks thats it from what he can tell. And the screen on my phone was broke. Question is, do I claim against her? It was her fault she was going round the outside of the roundabout too far:

She is red. The exit it is 2 lanes, I thought the way she was going round that she was gonna go into the left hand land and me onto the right. Before I knew it, me in green was trying to sit on her lap.
So what do you guys think, max to repair the cg is around £150 ex labour and my phone, iPhone 4 at £500. And the fact I'm going to need maybe 4 days off, back is bruised and cannot walk without help at the moment.
Go privately with her settle for 1200? or go though insurance? |

Sorry to hear about your wipeout op. hope you recover swift and dont let it knock your confidence. im still dead nervous on boutys since i was smacked. and its now a year later!
In regards to claim. It looks a bit hazy from where I'm sitting.
If you were on the roundabout already, and she pulled out into you, it might be a bit more black and white fault wise. But as it looks like you pulled out together, and if she was indicating right( I'm sure she was ) then her insurance might wiggle and put up a fight which may end in a 50/50.
See if she's definitely going to admit liability. Then go from there. I'd settle for 700 cash. But that's just me. ____________________ Chase my Witch up, Catch my Snitch up.

First: a Micra, what did you expect? No " ". Micras, White Vans, blondes in 4x4s, minicabs, anyone with heritage south or east of Berlin. Just stay away.
No chance are you getting cash in hand. With a back injury, she'd have to be a retard to not let her insurer indemnify her.
You'll want to get in touch with a specialist motoring solicitor straight away. White Dalton, SorryMate, pick your own. Tell them CCTV, police attended, back injury, they'll jizz themselves.
Do an overhead view of that roundabout, I'm not entirely clear on how badly either of you derped it up.

Pourquoi?
In all cases watch out for and give plenty of room to:
traffic crossing in front of you on the roundabout, especially vehicles intending to leave by the next exit
motorcyclists
cyclists and horse riders [only] who may stay in the left-hand lane and signal right if they intend to continue round the roundabout. Allow them to do so
I'm assuming that Mrs Micra collected the OP, so he was "in front". ____________________ Biking is 1/20th as dangerous as horse riding.

To be honest, I'd say that it's 50/50 at best. Of course, I've never managed to get knocked off, so I can't speak for the insurers.
Approaching that roundabout, I'd have preferred to be in the lane that the driver was occupying, so as to get off the roundabout at the next exit, instead of going from the inside across the traffic in such a short space.

I think you might be found at fault. She really should have been in the inside lane if she was going past that exit but it's not unreasonable to go that far around the roundabout in the outside: the next exit is just past 12 oclock and she might not have known the road. It looks like you crossed into the lane she was already in because you reasonably expected her to take the same exit you wanted, but how often do people go where you didn't expect them to? I think both of you were in the wrong lanes. If you push it you might both lose your NCD.
