Right...

Been to court 4 times now with DVLA, all because they don't seem to receive the V5s when I send them.

I am still waiting for one for the TL I got in July... Rolling Eyes

I've got a letter in the post about failing to notify for my R1, traded with JD on here, sent V5 off, job jobbed on my end.

Someone has applied for logbook as JD didn't receive it and he has since sold to another member on here I think.

I also have another one for a previous bike which was also sent off... again, same post box, same writing, different person listed on the V5.

They KEEP either getting lost in post, not delivered or just lost at DVLA sausagefest HQ. I post them, I'm not going to pay for recorded if they won't do the same.

Aside from my usual cover letter that I'm going to send along with my not guilty plea, is there anything I can do to get back at them, properly, not just send shit in a box.

If they made this affair a whole online thing, would be so fucking simple Rolling Eyes

Hmmm, could you take them to court for anything? Surely you have lost time and money pursuing this escapade over and over again? Would that stand up in a small claims court if you have all of the evidence?

Just thinking out loud, itprobably has no merit at all Confused

All they care about is monies, so I guess... press for your costs.

I just hope that recently discussed Crown Court fail isn't getting bandied about as precedent that the Interpretations Act doesn't apply. Mad

Try and get them declared a vexatious litigant.

I always send mine via Recorded delivery just to save myself the hassle like this. I know how much the DVLA mess things up.

They don't send V5s out via recorded mail, nor do they send licences this way... why should I?

FWIW I posted one recorded, they still took me to court with proof of postage.. so its not really that useful to obtain proof Laughing

I would however love to counter their claim with something like harassment, it is like every 2 in 5 logbooks I send them a year goes for a walk, the process is no different either Neutral I go through bikes, I follow their archaic backwards procedure.

Rogerborg has already done an FOI request - iirc they don't record losses.

Even if it doesnt get sent back recorded i always send stuff recorded. Its a small cost IMO for halving the chance or it being "lost" along the usual royal mail pickpocket line.

Skinny little DVLA addressed envelopes stand out like sore thumbs

They never seemed to care about the V5C's that I've accumulated. Including one for a car I wrote off in 2010 and another one that I sold in 2012, sent off the documents and received them back.

They don't sign for them anyway, so it's rather a waste of time to be honest. Just get proof of postage, which can you do on a second class stamp. Job's a good 'un.

That's sickpup you're thinking of. He's the man to speak to about this.

Be careful about assuming that proof of postage is sufficient any more. Here's what looks credibly like a failure in the Crown Court where the beak insisted that the Interpretations Act doesn't apply, and that there's a literal onus on us to "deliver" the change of keeper - although presumably to the "Secretary of State", if we're throwing common sense out the window. Thinking

Unless the DVLA are totally incompetent (nobody laugh) then they'll be citing that as a precedent now.

And I sent my last batch recorded delivery, and no delivery was recorded although they did get there. I'd assumed it was just a Royal Fail screw up, but if the DVLA are really refusing to acknowledge delivery, well, gosh darn. Shocked

Wuuuuuut thuuuuu...

The envelope (with two V5Cs) was posted around the 22nd of July.

I got the acknowledgements for both changes of keeper about a month later, say 20th August, just as I was starting to wonder what was up. Up to that point, the Track and Trace was still saying "being processed".

Checking today...

Oh, Royal Fail. That's well after I got the acknowledgements back from DVLA. Can't really blame them for that, Royal Fail are just flat out lying.

I'm starting to think the best way to avoid all this bollox is to register all your vehicles in someone else's name, since you don't have to be the registered keeper to be the owner or operator of a vehicle.

They argue the secretary of state should be "notified" yet insist you send the details to them,

If they are agents of the secretary of state and instruct you to send them the information is it not reasonable to expect the responsibility of "notification" to lie with them,

I read a response from vla on whatdotheyknow.com (I think) where the dvla say that non recorded mail is an acceptable way to send these documents and that it is at the senders discretion to use any other form of "delivery", they specifically say delivery.

Otherwise would their request that you send them the documents be deliberately putting you in a position of liability.

Does anyone know the secretary of states address so that we can start sending all our sorns and v5 change of keepers to him/ her directly.

Info for Secretary of State for Transport (clicky link).
Currently The Rt Hon Patrick McLoughlin MP.

The Department of Transport contact details are...

Personally when it says deliver to Secretary of State I'd want him to sign and recorded/special delivery. Otherwise how can you guarantee it was delivered to him/her? I wonder how you arrange an appointment to hand deliver this stuff?

Yet if you are not registered keeper you might have issues getting insurance. It's a question they ask and I know I had issue getting insurance just for me on one of my lad's old scooters. In the end he just transferred ownership/keeper via v5.

V5 is not proof of ownership, insurance want to know if the vehicle is "owned" by you.

I have a receipt. In fact, I think I'm gonna do just that, I couldn't care about the DVLA anymore, arseholes Thumbs Up

What alias can we give then, something clever and a little bit subtle.

I reckon everyone on bcf should start using the same one.

All the moody drivers do it anyway it is only the legit drivers that get the agro when dvla "lose" something.

Why have it their name if they are going to drive round with no insurance and all that faf

The other option would be to send them all off trade to a made up company, they don't add another keeper to the v5 either that way.

If you start getting sorn letters or anything like that you just change the name again.
