Thieving fuckers. Spent a night in Liverpool. Opposite the hotel there was a pay and display. I put my bike in it, but I tried to obscure it due to having no security, so I parked it right next to a wall at one end, in view of my hotel room window.

Wake up at 7:30am to go put some money on it. Go down at 11am and I've received a ticket for "not parking in a marked bay".

Well 1) I have a video of me putting the display ticket on the bike, you can't even see the bay lines for leaves everywhere, 2) I didn't want it to get robbed so wanted to hide it and 3) I paid £6 for that ticket!!!

How are my chances of appeal? This is a joke.

The signage may state that you must park in a marked bay, however you could argue that this rule is to prevent the car park being blocked up by badly parked cars - you chose to park tucked into a corner as you didn't need a full car space so felt it best to leave it available.

Could even go as far as saying you feared your bike would be knocked over during the night in a bay if someone wasn't looking properly when parking.

Pepipoo would be able to advise better.

Maybe you did park it in a bay, and someone else moved it overnight......

You could always appeal, argue that in the interest of proactive crime prevention you selected a safer area to park in as there was no specific bike parking available.

Parking on the pavement is only illlegal in london.

Ask for the by laws, they can't find any and withdraw penalty notice

Apparently not, parking on the pavement where there are double yellows on the road is also illegal

The red arrow is where I was parked, behind the tree (for obvious reasons). See all the leaves? Well it was worse than that. If anything, I made it so there were more spaces available for them to charge their extortionate prices.

I've not heard of anyone reasoning with them (rules are rules, and are not there to be bent, broken, or even slightly twisted Rolling Eyes )

However, if you couldn't see the lines you have no way of knowing it wasn't a valid bay, and on the road that means not enforceable (might have to be argued tho).

Never of heard of it being used, but I reckon that's your best shot.

If you can email them, mention you have a video showing the ticket being applied and the fact that, now you look at it, you can't tell that there isn't a bay there, which you presumably assumed when you parked up.

Never know, you might get lucky... Good luck Thumbs Up

I think you may find that parking on the pavement is unlawful everywhere in The UK.

That streetview snap seems to have caught a likely 'parking supervisor'!

These over enthusiastic parking charges and fines are what's killing a lot of towns, I won't go to Redcar ever again after getting in a blazing row with a warden ticketing my bike for not being in a marked bay about ten years ago.
(there were no MC bays, there were none in Redcar at all then).

I got out of a parking Penalty when I ask them to quote the law on this.

There is no law! Apart from London

Crib notes:
1) Do not ignore it.
2) Appeal against it. Mark it "APPEAL" in FONT OF GOD letters. Require a POPLA code.
3) Appeal on procedural grounds. POPLA are psuedo-legal spackers, they do not consider the situation, or apply common sense.

This isn't the best forum for advice though.
