RB I know you understand these thing better than me but I'm not sure that it is the sellers prerogative? The consumer has the option of rejecting or requesting replacement or repair. The seller can reject the option to repair if it is deemed impractical or uneconomical. This only leaves the option of replace or refund.

It may well be worth passing on a copy of this to the seller highlighting page 19.

Personally, if I had the money, I'd get a solicitor to draft a letter of rejection. You probably don't need it but it might speed things up. Always worth contacting MCN or a local paper. Remember that even if they give you all your cash back that you can also request additional money for damages to cover any costs or out of pocket expenses.

The rep at VD (how appropriate) saying the issues are minor is taking the piss. Stripping a bike completly then sending the frame to be treated and powder coated then rebuilding the bike is hardly minor. They cant claim youndidnt give them a chance to fix the issues, you did but the repairs neccesary went far beyond "minor"so quite rreasonabley you rejected the bike. The frame and its welds are a crucial and safety critical part. Just another point to put in your solicitors ear.

When I move to Glasgow im never going to even visit victor devine motorcycles. As for even looking at a new honda when I trade up next year, fuck that!

Another thing to remember is IF (I think you should get replacement/refund) you decide to let them fix it, you may not see it for months...

They'll keep saying they are waiting on parts or whatever and will just make things worse. Then when bits are done to it, it won't be up to the standard you want and it will just get messy.

Rikki, has your solicitor advised you how to actually enforce the rejection? If VD are refusing to accept it, might it come down to parking the bike outside their showroom, throwing the keys over the counter, doing a change of keeper to them, and then starting the process of invoice -> letter before action -> claim?

That'll leave you out of pocket (and them with a free bike) until it's settled though, so presumably that's a last resort.

Yeppers. Once something like this hits social media things soon change.

The strange thing is, if they do the right thing and provide excellent customer service by ensuring Rikki is happy and refunding him is money the reputation of Victor Devine Motorcycles in Glasgow will improve.

But at the moment their name aint worth shit.

Thing is now OP may get a whole new bike or his money back but now it's hit social media it's the Streisland effect (sp?) - more they try and hide it, more it'll appear.

Damage is done, well and truly. I wanted a CBF125 but after seeing this I'm going to avoid one.

Otherwise people looking for reviews in the future may be swayed by this and not just for 125 sales.

From my experience though the manufacturers don't do anything about dodgy dealers. Why I don't know. I'm guessing it's because there's always someone else lining up to pay them for the franchise.

Far better if dealer had said fair cop, it's probably just a one off, we'll let Honda quality control know, these things happen, how can we help you.
