Brighton Road on the A259 is 2 miles of straight flat boringness, and I found myself behind a 25mph car. There's keep left signs all the way along and you have to be nippy to get past most of the time.

Coming back home at 5:30 it was dark, so imagine my surprise when I happened upon an unlit sign on a traffic island whilst still just alongside.

I don't know how I avoided the car as I did a leftward bit of last second avoidance, it was sphincter-loosening stuff.

But I got to thinking, if I'd hit the island (or the car come to that) what culpability would the council* have?

*Or whoever

I think the council would have, with a certain degree of justification, claimed off your insurance for a new keep-left sign.

If you couldn't see far enough ahead to see a traffic island with a keep left sign on it, lit or unlit, I'd suggest you should not have gone for the overtake.

You've a point, but this particular sign (and others along there I noticed) are withered remnants, with all too solid islands underneath.

It's dangerous because people expect them lit and visible, I won't be now Shifty

If the keep left sign/bollard is within 50 metres of an electrically lit street light which forms part of a system of street lighting not more than 183 metres apart then it should have been in lighting.

If it's not within 50 metres of a LC then it should be reflectorised to show up properly in your headlights.

As well as knowing the darn things don't necessarily have either sometimes Rolling Eyes

I used to do a night time street light scout in the 90s. It was stopped to save paying me and my colleagues the over time (it wasn't our main job). That lasted for about 12 weeks and then some top chap drove into a central island with no KLB on it and wrote his car off.

The insurance company asked to see the scout records and my employer had to tell them they had stopped the scouts. The bloke got his payout with no fight from the street lighting authority, my over time was reinstated instantly.

Sounds like a dangerous overtake to me. You clearly didn't have sufficient awareness of what was ahead of you, else you would have seen the car coming. You're supposed to be on the left, you weren't, so it would be your fault entirely. You don't need a sign to tell you that.

Leaving aside the legalities, spending all that time in intensive care and on recovery in wards won't be fun. I'm not trying to have a go, I just think it would be a really crappy few months [for you].

Wrong end of stick, I was overtaking the car - you mean the keep left, right? Wink

Point taken though, I'll stick to swearing next time.

Overtaking on a road which is lined by keep left signs? Sounds like a dumb thing to do to me.

Brave overtaking there! Loads of the damn things on that stretch! Consider yourself shamed. On the warped factor somewhere between girlfriend and horse but not near shitty fish fingers.

careful claiming against the council.

My brother was T-boned as he crossed a busy A road in his C2
A route he'd driven before but not often.

no sign warning of the junction, told by the local residents who came to pull him and his wife out that it had been taken down a week ago to be taken for 'cleaning'

he tried to push this route that there was no signage and was told in no uncertain terms by the police that they'd push in return for dangerous driving / due care and attention.

he ended up with a speed awareness course

It's not a claim I ever intend to make, more 'just supposing'.

I'd rather have real legs to stand on, rather than legal..

I was.
RTA, I had choice to pay, I think it was £25 or give them my insurance details so Ambulance Service could make 3rd Party Claim.

I got a bill in 84 when I was run over by a car. I threw it away and heard no more. These days they want you to forward it on to your insurer to deal with I think.

The '84 one I'm not sure of but it looks like the 2003 legislation allows the NHS to recoup the cost...

Quote:

Under the 2003 Act ambulance charges for the purposes of transporting the patient to hospital are recoverable per person, per journey, regardless of numbers carried by an individual ambulance

..if you're making a claim against someone (insurance claim).

Quote:

This applies to each ambulance journey to hospital, or transfer between hospitals, in relation to treatment of the injuries for which compensation is paid*.

*my emphasis.

Since my RTA didn't involve anyone else I'd guess that'd be why I wasn't charged. Your two incidents involved other vehicles so I'd guess they expected that you'd be claiming.

At least that's how I've read it - though I did just skim.

At the end of the day, if you can't see where you are going, slow down until you can see within your stopping distance.

Ignore this simple rule and you deserve to die in a flaming ball of fire.
