evenin

so last week i purchased somefink off ebay. it arrived on wednesday. i changed my mind and didnt want it. messaged them saying exactly that, can i return it. they replied and said yes, send to xxxx address.
thursday morning i take it to the postoffice, pay for 1st class potage. she puts the stamp on it and gives me change. i get back to the car and realised i didnt wait for the receipt.
messaged the seller on ebay that id posted it back
friday evening sent another message hinting to let me know when it arrives. replied saying it hadnt.
messaged him yesterday afternoon saying if it hasnt arrived by the end of the day can he let me know and ill try chase it up. not arrived, asked me for parcel tracking number.
this morning i went back to the PO and explained i didnt get a reciept, could they track the transaction on the system and let me have details or look themselves. lady said there would be no tracking number as it went first class, not recorded.
i messaged the seller back saying that this morning and have had no reply all day.

so, have i lost £45 i wanted refunding? is there anything i can actually do? i have 380+ positive feedback, if i open a case stating ive been fucked over hes just holding back refund will they laugh at me or give me the benifit of the doubt? his feedback is high 90% but a few negs about postage.

what should i do?!

Not a lot you can do. You are now relying on the seller being honest and admitting they have received it.

If you dont send it recorded then at the very least make sure you have a proof of postage or you are as good as throwing it in the bin when you hand it over at the post office.

You wouldn't accept "I posted it, not my problem" from a seller. Why should they accept it from you?

Recorded delivery or GTFO. Sorry.

Fair point. But surely the PO must have details on the system for it? Must be logged somewhere?

If you sent it with no tracking, then there's nothing to track it by.

If it has gone missing in the post you're going to need to claim for the value of the goods from Royal Mail, hopefully you chose a postal service that will cover the cost of the items in the parcel.

They do...I got paid out compensation for an Ebay item that I posted but never arrived at its destination (apparently!!!).

As long as you have your proof of postage I think its cover up to £20...special delivery its about £200.

Does The Interpretation Act not cover Ebay then?

The receiver has no contract with the courier though.

It is the person who posts it that has the contract, therefore, if it goes missing when he posts it, and he wants his money back, it's his responsibility to place the claim.

Fuck all to do with Ebay - the contract is between you and the post office.

You can £20 compensation from Royal Mail. But if you only posted it last Thursday then it could well still arrive.

380 feedback and you don't know not to send things without tracking? Laughing

Under no circumstances do you send anything without recorded delivery, minimum. I think Royal Mail will tell you to wait 15 days before you can start to raise a claim.

You cant claim £20 unless you have a proof of postage...which the op doesnt have.

I am reading this right.

You bought something, didn't want it so seller accepted it back, you sent it back without getting proof of postage.

The item went missing, now you want to know if you should fuck the seller over by instigating a claim against them.

nice.

no you shouldn't, you should man up and take the hit. it's not the sellers fault your a tard.

Check your facts, it's all on the Royal Mail website; how much can be claimed and when it can be claimed.

Why would I change my story? I asked for opinions, calling me a tard might be correct but it doesn't change what's happened and doesn't offer much advice. So who's the bigger tard?

Although I've fucked up I'm not the one with dodgy feedback related to deliveries. I'm wondering if there's a slight chance whether I had the receipt or not if the seller would admit receiving it. Hence originally saying I wonder if I could trace the delivery thru PO records so I could at least put a claim in.

Its £20 correct..but you cant just claim on here'say. Otherwise people would be doing it left right and centre. You have to have some proof that you actually posted something...this proof is obtained when you hand over your parcel at the post office, they print a Proof Of Posting receipt.

Taken from the Royal Mail website:

'The claim form needs to be signed and dated by the claimant and supported by “additional evidence” (evidence of posting and evidence of value)'

And to add, it's not lost yet. RM do not consider it lost until 30 days(or something like that).

It's just delayed.
