Ok, so I am really annoyed with DVLA.

The tax on mine and my wifes motorbikes expired at the end of september last year and, as such, we had had a reminder for both in the post.
I had only recently returned to work after redundancy and so filled the forms in on the day they arrive stating the vehicles would be sorned, popped them into the same envelope and sent it on its merry way.

I never thought anything of it as the start of november the work contract ended and so it wasnt something that I was anxiously looking for, you know, the letter saying, 'thanks for telling us you dont want to ride a bike on the road'. (waste of time and a way to get money out of motorists who do pay tax and dont ride/drive illegaly).

anyway I received a letter stating I hadnt sorned the vehicles and i would be fined. I tried responding and in the end spoke to someone who said that it was obviously an oversight and that the records should be updated.

NO.

sigma has now sent letter stating I owe them £80, currently this is only one bike that has been sent so if the other is declared as sorn why isnt this one, but if it isnt then guess this I'll get a letter for that soon as well.

The thing is, I phoned sigma and went through all my finances (as still not working) and myself and my wife are on negative desposable income, he agreed we could pay and has put it on hold for 30 days.

Heres my deal, surely I had adhered to my part of the contract by posting said declaration about the bikes.. what can I do?
AND £80, thats actually MORE than it costs to tax the bike for 12 months!

Just how I see it

Stop discussing paying 80 quid to the thieves, tell them you SORN'd the bikes it's not your fault the DVLA is incompetent and they can see you in court should they want to pursue their £80, should it go to court you will pursue them for costs. After this ignore all further communication from the thieves, wait on a court summons if it ever arrives

Check if the other bike is SORN if it is your story becomes much stronger

If it goes to court insist you SORN'd both. Point out it is not your fault if the DVLA lost the paperwork or didn't action it. If the DVLA claim it never arrived then point out that's down to the Royal Mail you posted it as required.

I'm fairly sure they have to prove you failed to SORN it, if you say you did and it was lost in the post or lost by the DVLA then it's on them to show otherwise.

I said fuck all until court letters appeared. I said to court I had sent x documents. Courts said OK, 2x10+1 Romeo Dunn.

Obviously might not work, as in I think it does not work with SORN stuff, why you didn't do at post office or anything, I don't know but you cannot trust post office/dvla to work together as one.
