Speeding and making a phone call does not careless driving make.

Being out of control after some stupid cunt drives into your car isn't careless driving either.


The equivelent is when a guy careered into a load of cyclists on black ice. He had a couple of bald tyres BUT because the bald tyres had no bearing on the skid (treaded tyres would have skidded just as much) he was found not guilty of dangerous driving.

This is no different

Doesn't matter. She's admitted to one count of breaking the law, and two counts of things that are gonna be looked upon dubiously.

The report would suggest that the airbags went off due to running the kids over, rather than the initial impact.

Rightly or wrongly, shes stitched herself up good and proper.

There is a difference. Making a hands free telephone call is not illegal. Driving with bald tyres is. I hope the driver on black ice still got a relevant punishment for driving an unroadworthy vehicle?

Yes he did, 3 points for each bald tyre (concurrent) plus the appropriate fine (I believe about £60 a tyre).

He wasn't penalised for the multiple deaths, though, as the bald tyres HAD NO BEARING ON THE CAUSE OF THE ACCIDENT, which was the black ice.

It's more like someone admitting to operating outside the legal limits, encountering an unexpected event, and subsequently being out of control.

I'm not even arguing for the CPS, the speed may or may not be a contributing factor so I guess that's for the court to determine. But at the end of the day two kids are dead due to a sequence of events in which she was (unwittingly) involved. Do you expect her to walk away with a speed awareness?

Put it this way: If you are speeding, have a blowout, and slide through a bus queue, who pays the piper?

No it's not. It's more Force Majeure. Some cunt drive into her car. She lost control due to that. If the driving into the car hadn't have happened she probably wouldn't have lost control. She would have probably lost control if she hadn't been speeding and using the phone.

Quite why the CPS have pursued this one is beyond me.

The problem is two people died, and a thorough investigation must be made. The only test the woman has is through a court, and that is what is happening.

She won't be found guilty of the death, if the facts presented are true. However, this is what court is for to test those facts. At most it will be careless driving for speeding, although that is questionable.

She may get points for speeding though.

You are perfectly correct that with a couple of dead kids in the picture that she will get the book thrown at her, but that's not a point anyone is arguing with. The point being made is that she shouldn't.

She was travelling at almost the bottom of the speed at which a camera would ping you, while talking on her phone in a legal manner. She was about as close to law abiding as you can get without actually being innocent of any driving offence when someone struck her - to hang the death of two children on her because someone, as you put it, has to pay the piper, is absolutely disgusting.

That's the point everyone is arguing with. The thread is full of conjecture and hyperbole.

Should she get the book thrown at her? Probably not.
Was she responsible for the death of two people? Probably not.
Was she behaving illegally at the time of the incident? It would seem (presumably by admission) so.
Is this a causative factor? That's for the jury to decide.

That's disgusting!!

Was there a speed camera present at the time? Or a copper with a speed gun? If neither, speed cannot be taken, she can just say, I was shocked I don't know what the actual speed was.

She was talking on her hands free phone, that is not illegal and is simply a fact which should NOT be even spoken about. By all the accounts this woman was driving legally.

The fella crashed into her, car would have changed direction, what does the highway code recommend as to action to take once youu have been struck by a car? She did nothing wrong, when you get crashed into that's when your liability surely ends.

I am the judge here, the woman IS NOT guilty of the murder or manslaughter of those children, the old duffer in the mini is.

I hate this world we live in! She'll probably have to pay to get her car fixed too, not the old prick's insurance because it's her fault shee didn't avoid it!
