Arrested, not charged. It's vanishingly unlikely that there will be a prosecution, let alone a conviction or a meaningful sentence. It's not like a person has died.

No one will see any jail time, if they can even prove who the driver was they might get banned for a year if you're lucky and a few hundred quid fine.

I think you'll find that if you're a cyclist you're even less valued as road kill. The sun was in my eyes is it would seem a good excuse, or even the old I couldn't hear the man screaming as he clung to the front of my truck for a hundred yards before finally going under the wheels.

So the tyres are not the responsibility of the driver? Absolute bollocks. The driver shouldn't be on the road at all. That should have been the deciding factor. If when the key was put in the ignition there was no insurance then you are carelessly driving. If you cause a death by not being in proper control then you are being careless. If you cause a death when you shouldn't be on the road your a cunt and should go to jail!!!

As far as I was concerned the law has always dictated the the vehicle you are driving is your responsibility and to check everything over before starting a journey. She didn't check the tyres, or she did and ignored them, thus she vetoed her right to use that as an excuse.

It's almost like saying "Oh sorry, I was reading a text when I hit him, it wasn't my fault though, it was the person who sent the text's fault".

The CPS was originally created because the police were flooding the courts with no-hope cases on the off chance of getting a conviction. CPS have now it seems gone totally the opposite end of the spectrum and refuse to prosecute anything where there's the slightest chance of the accused offering a remotely plausible defence.

MY car has mismatched tyres, probably because of the cheap previous owner. At least when the missus bins it into someone she won't get done.

Mine has one called "Triangle" Laughing Odd name for a round tyre I thought. But still, while it may be a ditch-finder tyre, I can drive happily knowing if I mow someone down I have a get out of jail free card.

Perhaps it was because the Police defaulted to charging a more serious offence when they could, racking up the cost of crown court trials instead of magistrate court only misdemeanours? The CPS is target and cost focused.
