Just received our possession notice today from the courts for the flat we currently live in,
Story in short:
Moved in feb 2013, agreement was pay whatever the council will pay for rent which was about £346 (landlord assumed it was £400)
we didn't know until the first month had been paid that was the case but we continued to pay until the landlord got arsey with us as it wasn't what she expected.
We went a month with no hot water or heating as we had no boiler, it eventually got fitted at my partners grandmothers expense and was fitted by a non gas safe bloke which was arranged by the landlord, this was put right at our expense.
The bath was a half sized bath and was absolutely fucked, the sink was also broken, chipped and hanging off the wall, the toilet cistern is broken and doesn't flush you have to put your hand inside to do it (still do now 14 months on) i replaced the bath and sink at my expense, not the toilet as my plumbing knowledge only goes so far and funds where tight.
Most of the walls have damp and mold over them which need to be cleaned weekly.
3 of the 6 plug sockets don't work.
The old boiler control switch is still on the wall, damaged with live wires semi exposed.
We ended up paying a top-up on the rent out of our pockets to make the £400 she expected it would be and she still refused to do repairs due to "lack of money"
she got fed up with waiting for us to pay the housing benefit into her bank so she lied to the council telling them we haven't paid her rent for 8 weeks just so they would think we have been keeping it so they pay it direct to her, because of this they stopped our housing benefit and she got no rent which meant she demanded money from us to pay for the rent she didn't get due to her lies.
My partner started work over Christmas and housing benefit was stopped due to a misunderstanding, we had no idea about this as we no longer see the amount of money we get, until the 16th December an eviction notice landed on our doorstep due to non payment of rent in November or December.
After a lengthy phone call we semi sorted it out and landlord wrote to us agreeing she will write the arrears off if we keep paying rent like normal and retract the eviction notice so we did.
After another mix up with housing benefit the landlord got overpaid £110 and has to pay it back which she is demanding from us as its coming out of her pocket. and we technically still owe her it (we wouldnt have to if she hadn't lied to the council in the first place as we would of known)
Because of this we received a possession notice to attend court on may 28th for the rent arrears of £110...
The possession notice is full of lies i.e the rent shes claiming the agreed amount was £412 a month when in fact it was whatever housing benefit would pay which she then changed to £400 because she wasn't getting enough.
we have a statement of our recent payments which clearly show her lies
in feb 2014 we paid £313.76, then just below it says again feb 2014: £346
housing benefit pay around £360 and we pay £40 none of this is mentioned.
Would the old eviction notice still stand even though she said she will remove it and wipe the arrears

Yeah weve been looking for a couple of months now, i spent a fair bit re-decorating this place only for the mold to ruin it, this was unknown when we moved in as 99% of the flat was painted white and wallpapered by a moron so it was hidden.
I have no doubt we will win in court but there is still money owed which i know the court will want us to pay, i don't feel i should pay a single penny to the landlord.
The landlord even forced my gf into working for her for below minimum wage just to help pay the rent.

In your position, I'd have been looking for somewhere else by about March 2013 which would have given me plenty of time to find somewhere by now.
The writing was on the wall when you moved in.

If she magically "discovers" a contract, get a copy, go down to the cop shop, and make a complaint of fraud. Don't bluster, don't threaten to do it, just do it. Calm and insistent.

we where given a tenancy agreement which was printed off the internet with I think says £400 so still less than the £412 she claims it is. This was only for 6 months, we weren't given a new tenancy so im now guessing were on a monthly contract.
We pestered he landlord for ages to actually get the tenancy agreement and we have no rent book after months of asking.
The landlord has been round a few times attempting to let herself in when the rent wasn't paid on time, we had to change the locks because of this.

when you find somewhere else, lift a few boards, do a 1 + 2 before replacing them.
Do this as many times as possible, Also if you have any frozen meat, cut it into golf ball sized chunks, and find as many out of sight little holes as possible to hide it - behind skirting boards, air vents ( if wall is cavity you can put a fair amount up there just be unscrewing the plastic vent cover)
This is of course after arse-raping her in court for being a greedy 2 faced twat |

So anyway:

Please also remember that if she is letting out her council flat to you, you will pretty much have no rights anyway.
It is now a criminal offence (on her part) to sublet a council flat. I don't know what action they will take against her as the illegal landlord, the council will certainly eventually evict you (this has happened to me in the past).
If she is the owner of the flat, you can really only prolong things by putting a section 6 notice in the window until such time as you can find a new place to stay. Best off moving out for a bit of peace and quiet, and besides, family (if such is the case) is overrated at the best of times. Moving out now is a quicker and less painful way, than dragging it out.
But close any housing benefit claim you currently have open (otherwise the council will claw back any "overpayments" later and this might make it difficult for you to claim housing benefit at a new property at a later date) - don't pay anybody any rent until you do move, save any money you earn for the deposit on your next place.
If it is a council flat being illegally sub-let, sit tight, pay not rent, stick the section 6 notice in the window for the supposed-landlady, flip her the bird, get a job with someone who pays proper wages, and wait for the council to send you a date of eviction.
None of it will help very much at the housing department if you apply for homelessness, other than that if you are officially evicted whether by the landlady as a private owner, or by the council as the landlord, you didn't make yourself homeless (a very important point of law)
But its actually a moot point in this day and age of councils never having any housing stock anyway.  ____________________ Not nearly as interesting in real life. |
