Hi all,

So a friend of mine took his bike to a place where they were meant to do valve clearances, dyno, remap etc.

As soon as he got the bike back it started to run rough. Wouldn't cold idle and flames pouring out of his exhaust.

It turns out they have fiddled with a load of stuff that didn't need touching.

We took it to a mate of mine yesterday and he adjusted the idle which sorted out the rough problem but my mate has had to disconnect his PC3 now because since they mapped it, it is f'ing up the whole bike. Making it run like a dog and pouring out flames.

The garage is refusing any liability with it and saying he will need to pay for another dyno run and tune! wtf!!

Any legal malarky we can hit them with?

Legal malarky yes in theory. Your friend paid them to do work (that is hopefully on the invoice?) and they've either not done that work, have done it wrong or have done other stuff that they shouldn't have. Either way, they haven't done what they were meant to and they liable for what they did.

Hopefully you haven't told them anything about your mate adjusting the idle and disconnecting the PC3 as the garage will just try to blame everything on your mate.

Is it a small independent garage, a main dealer, part of chain, etc etc?

If they have it's a self-regulating garage services body who take
membership very seriously and will help you get the proper service from the garage.

Get it documented what exactly he asked them to do (which was hopefully more specific than "Make it faster, mister") what's gone wrong, that he's offered them a chance to sort it out.

Take it to another garage (not a mate) and get a written evaluation of what's wrong and an estimate (time and money) for them to fix it.

Show that to the tuning place, offer them another chance to sort it, or let them know they'll be paying that (retail) cost elsewhere.

If they tell him to sod off again, pay up to get the bike sorted elsewhere, then send the tuning place an invoice and start the long route to a small claim.

Sorry, there's no magic wand that you can wave to make a bad outfit sort out their mistakes in a timely fashion. The above is what I used to get a pre-court win against a car garage. Get plenty of documentation that you've offered them several chances to sort it out.

Sometimes if they are a dodgy bike shop not making much money lately over a period desperate for revenue, and they have gone down the line lets do something to the bike which means the customer will have to come back AGAIN, if gullible enough, and pay for ANOTHER service & repair fee to get the bike running properly because they know exactly what they did to it to make it run that way?

(Shit, am I becoming a member of the grammar/spelling nazis club? Rolling Eyes )

It's depressing to see problems like this. If they're a bunch of cowboys who thought, oh we can fix and tune bikes, done it for me mates, lets make some money, then the hope is they'll soon be out of business. If they're a proper set up with knowledge and experience enough to make it a viable business, then they should own up to their mistakes and do everything in their power to put things right, no questions. Customer relations is every bit as much as important as the actual bike/tuning work, if they want to last in this game - why can't these fools see that? Rolling Eyes

If you end up having to chase this all the way and they continue to deny liability, THEN you should name and shame and publicise their shoddy attitude, and not just here.
Give them all reasonable opportunities first though as Rogerborg says; every business makes cock-ups, and it's not always in the knowledge of the business owner.

Why was the work necessary in the first place? Was it having problems? Why did it need a remap? And what exactly are they saying about their side of the story? Do you have all your facts as presented here right, or has your mate not told you the whole story? (remember what we've had here in the recent past about only getting a part of the facts).

No one here can advise properly on the best course of action if there's some hidden/missing info from your posts.

He could just revert the Power Commander back to a standard map.

What is important though is exactly what was asked for.

Thanks for the replies from everyone. I will pass this on.

He basically went in and asked for valve clearances and also a custom map for his bike that improved performance and power delivery through the rev ranges.

Yes he can revert back to standard map but then he has wasted the money he paid them...

It's been a while since I used a PCIII USB, but can't he download the map from it and save it on his computer prior to resetting it default?

Yes he can do that but obviously the map is wrong if it isnt making the bike run better!

So the issue is that they have taken his money and not given him what he wanted

Vehicle repairs and servicing


When you take your car to a garage for servicing or repair, you enter into a legally binding contract with the garage owner, which is controlled by many laws including the Supply of Goods and Services Act 1982 and the Sale and Supply of Goods to Consumers Regulations 2002. These laws give you certain consumer (sometimes referred to as statutory) rights under the contract. You are entitled to expect that the work is carried out with reasonable care and skill, within a reasonable time and at a reasonable charge. If a part is replaced, the new part should be of satisfactory quality, fit for purpose, and as described.

If a fault has not been repaired properly, you should allow the garage the chance to fix it. If it fails to do so, you may be entitled to get the work done elsewhere and recover the cost from the garage. If the garage fits a part, which turns out to be faulty and it has not been fitted very long, you may be entitled to a refund, or you could ask for the part to be replaced.

It is a criminal offence to charge for work which has not been carried out and any such complaints should be forwarded to the Citizens Advice consumer service for investigation by trading standards.
