As i rode home this morning at 2am, after a night out on the town (no i didn't drink, wish i had tho and left the bike in town ) I came across the thought of;
Is it illegal to carry a drunk, or someone over the legal limmit as a pillion?
As its ok fo a car driver to give a ride to a drunk person, so is it ok for a biker to give a lift to a drunk? Ok so it may not be safe but i was just wondering.

In Texas (i think its there, if not its another state) its illegal to drive within an arms length of alcohol, even if its in someone elses bloodstream... Stupid fact but its slightly relevant  ____________________ Bike - Honda NSR125R1 (Sold)

For it to be (involuntary) manslaughter they would have to prove serious negligence. the actus reus is -owing a duty, -breach of that duty, -resulting in death.
Ergo you would need to think, do i owe a duty to the guy on the back -yes. However does it get affected by whether hes drunk or not? Bearing in mind if your twatting about and hes sober and dies, its still causing death by dangerous driving.
I would say go for it, but just be careful, dont go for kneedown, monos or anything too savage.
