Ok this is really upseting my GF and me, and I am at my witts end.

2009 I was caught speeding, and find, I paid the fine in installments. They lost the final payment. in 2010 a warrent was issued for my arresst and an officer was sent to my home address.

My then wife proved to the officer payment was made. by showing the bank statment to them with the refrerence on there and that was it, she left, and I have heard nothing since.

THEN! in Jan I reiceved a letter from the courts demanding the outstanding payment of £50.

I wrote to them saying this was paid on the 10th Jan 2010 and this was proven to the women officer issue to serve my warrent.

They then wrote to me again asking for the evidence, I explained to them this was 4years ago, and I no longer have this, and I have split from my wife, I advised them of the date, and the name of the account holder an email address used for payment.

I then recieved a letter from their collection agency with a bill for £125 for the costs and fine, I called them and got my partner to speak to them as I would have laid into them big style. They requested I needed to make contact by the 26th may to prevent further action. I sent two letters, one to the courts and one to the agency on the 20th May stating all of the facts.

Today the bailiffs have turned up on the door and have charged me £360 for the privilige.

This is now getting beyond a joke. I have requested the official complaints procedure from both parties and have advised them I will be charging them for my time.

Seeking legal advice from a solictor wont work as I cant afford it.
CAB will be contacted, but I have never had any help from them. so not holding out much help.

Any Ideas?

Ignore till you get summoned to court.

Provide details of the arrest warrant (May be able to get it on a data protection act request from the force that dealt with it).

The bank should still be able to get that statement also.

If it does go to court, counter claim for the costs of getting the information.

How the hell will I get the information from my exs bank though? I was solely in her name. I dont even think she has this account anymore, and I have asked her since Jan for this information again!

No doubt they'll have to hold the information under the Data Protection Act or something for X number of years.

You'll probably have to take her with you mind, with every piece of ID under the sun, but they should have it knocking about somewhere. They don't just delete your data when you close an account.

You could ask her? Record the conversation so you can prove you tried to get the evidence.

I don't think the bank can or will provide the statement to anybody without her permission.

get the reference relating to your arrest warrant from the police force.

£350 fees for a £50 debt?

I thought the fees couldn't go above the original debt amount

Have the police got reccords from the officer coming to serve the warrant?

A personal rule of mine is to never deal with debt collectors. Several have been after me for many years now, over bullshit amounts, that I didn't owe in the first place (admin fees added on after closure of accounts mostly). Because I've never responded to them, they've never stepped up their campaign. They've never sent a collector, even for the one that's allegedly £370. They just keep sending angry letters and offers of reduced settlement (the £370 went as low as £32 full and final settlement), but I know if I call them to settle, they'll ramp up the campaign again as it confirms they've got the right person and that I'm willing to deal with them.

If it ever goes to court, I'll defend myself, but as yet they've never taken it beyond the angry letter stage. I did enjoy the letters from what looked like newcastle magistrates (I live in norfolk) threatening me with a court date, that upon closer reading were not from the court at all. They did make me chuckle.

Going too, was just on hold for 38minutes then cut off! The other half is dealing with the calls ATM, as I'm not in a fit state. Unfortunately nag debt helpline said I have to pay it if can't come up with evidence. As there word against mine, and court bailiffs are allowed forcefull entry

Court bailiffs are not debt collectors though.

And you need to go to court before that happens.

I'm reading this as being a court fine, and those are likely to be real bailiffs, acting as bullet headed agents of it.

So I'd get down to the court and speak to someone about it, face to face.

Ive recieved the offical complaints form for the police and filled in and returned, They are holding off bailiffs again for me to provide proof!

I have requested information on the dates and payment details for the payments they do have, so I can trace theses. Once I get this information then I can get to the correct bank.

If they cant supply me with this, then they cant keep records, then how can they prove I havent paid?

I filed an offical complaint with the court service requesting information and stating the issues, recieved a letter saying being looked into and will have the response within 10 days. that was 42 days ago now! no reply...... umm!

You need to fill out an official complaint enquiring as to why your original official complaint has not been responded to.
If after that they are slow to reply; threaten them with an official complaint ! Thumbs Up

Well they turned up again a few days ago (Marston) told me there is a warrant out for my arrest! I never heard from my official complaint within the given time, so assumed was over! but now, they are telling me there is a warrant out for my arrest!

However the weekend my daughter found the original letter from the courts from when I originally proved the payment, thanking me for providing the evidence! I am going to forward this back to them again!

I would be inclined to take it to them personally (after making copies) and get confirmation from an actual bod to say they have called off the hounds.

She just picked it up off the floor! It must have been in with some other paperwork that someone disturbed! Glad I kept it! The onus is now back on them to trace the payment now!

I'm doing everything in writing to have a nice paper trail!
