Hi Guys

New to the forums, and a new-ish biker just looking for some advice.

I received 2 parking fines for parking my bike (Yamaha TW) on the pavement outside where i live, chained to the gate (leaving loads of room for passers by). I received these within 24 hours of each other - today and yesterday. I didn't see the first notice because it was dark (and chucking it down) when i got back from work, and got up today and found both fines.

I've only had my bike about 5 months, getting through the cbt earlier this year, and was never completely sure whether parking on the pavement like this was ok. Previous to this I had managed to ask a couple of passing policemen whether i could - they assured me it was fine. Unfortunately no proof this ever happened, and until now ive seen no reason to doubt it!

My new research has revealed that Lewisham council prohibits this, but all over London the rules for this are sketchy at best and vary from council to council....

Im OK with paying the first fine - i was in the wrong - costly mistake! But the second one in such a short time frame seems completely unfair, its obviously the same guy that's come back for me the next day and slapped another ticket on for the same offence.

Any advice on things i can say/do to help me appeal against this second ticket?

I don't know the local area but i always thought if there were no yellow lines in the adjacent road and you aren't blocking pedestrians then parking on the pavement was OK. Look forward to hearing what the BCF opinion is.

Either way total jobsworth for handing out 2 tickets. Imagine you could try saying at least one blew away/was taken off before you saw it and not have to pay that?

Lewisham is a scummy place, I rarely take the bike there for this reason. I've seen some cheeky fuggers ticketing cars with 1 wheel on the path ever so slightly, bad parking true but fines, really.

Be clear: parking on any footway (pavement) anywhere in Greater London is an offence, unless specifically allowed.

Plain English.

Highway Code 244.

The law backing it.

Now, there is a defence of parking "in accordance with permission given by a constable in uniform": shame you have no evidence of that.

Could you get some? Now, I mean? On film?

You could point out that parking on the footway means that you are guilty of "an" offence, not two offences.

Get yerself to Pepipoo - plenty of people on there who know their shit. If there's an out, they'll find it.

At the very least, you have a single parking offence if the bike wasn't moved, so multiple tickets is clearly unfair.

Is it a house that's privately owned? It's worth checking where the property boundary is, a friends parents once had an issue with Arriva because people were parking in the layby bus stop outside their shop. It turned out that they owned the layby and were simply allowing Arriva to put a bus stop on it.

Appeal explaining that you have no where to lock the bike up and the bike wasn't causing an obstruction.

You will have to find another place for it tho!

Few years ago now but I got off a Westminster pavement parking ticket by telling them that I'd broken down and it was the best place to leave the vehicle whilst I got the necessary spares and tools from a mate.

This might not work so well if the bike is registered to the address that the bike was parked outside of. Laughing

Thanks guys ive got some good advice here and on pepipoo. (great site!)

Im planning on writing up the appeal tomorrow. Im thinking ill have more chance getting let off the second fine, with both claiming ignorance in the first place, and then not being given enough time to correct my mistake, or even see it in the first place. My bikes now in the road, so this will be the end of it.
