Hi so I sold a laptop on ebay and the person who purchased it said he has taken it into a store and they updated the bios and it failed. Where would I stand with regards to paypal and stuff. In my view I am not responsible at all for it as the computer repair store were the ones who updated the BIOS according to the buyer. The laptop had an OS and booted fine etc before I sent it.

Surely they should provide some sort of guarantee or something for liability. I said it had warranty on it from lenovo which it still is until November. The buyer asked if it had warranty as the computer repair store said that it would need to be sent to lenovo. My guess would be a BIOS update would not be covered under warranty but I am not sure.

Thanks

Why did he take it to a store? Were there any problems with it? And what is the buyer wanting to do? Also, how long after they received it have they complained about it?

I would suggest that if you sold it in full working order (and you can get something in writing from the buyer that agrees) and someone else has since done something to the computer, it isn't your responsibility. It's no different to you selling me the computer, I then delete everything on it and complain to you that there's nothing on it.

If he opens an eBay/Paypal case, they'll review the messages exchanged between you, so make sure you steer the conversation towards establishing that it was working when the buyer received it, and it's something he's had done that has caused the problem.

That said, eBay and Paypal overwhelmingly come down on the buyer's side. Be prepared for them to offer the buyer a full refund, to keep the item, your car, house and the entire contents of your bank accounts.

Yea I have in writing on ebay that he said it all worked fine but then something went wrong when updating the bios. I then asked who updated it and he said he knew nothing about computers so took it to the store. He took it there as he wanted windows 8 putting on it. So he has confirmed that the store updated the bios not him and that it all worked fine before updating it so I guess im ok. He has left good feedback any way so hopefully i will be ok. I know in the past how biased paypal are towards buyers. In my opinion the computer store should go out of their way to sort it out.

You're in the clear, even manufacturers don't offer any kind of "if this bios upgrade borks" warranty.

If you buy a bike on ebay, take it to a garage for some work to be done and they blow the engine...?

Ask about why he wanted the bios to be updated.

Be careful about the warranty from Lenovo because that may or may not still be valid when the laptop is sold second hand. This page has someone saying "Although the laptop is still under warranty, Lenovo refuses to transfer the warranty to a new owner. I'm hoping the issue is software related and someone may be able to shed some light on it."

Ask about how it has failed. What failed? What bios version were they trying to update with? Where did they get the bios update from? Ask what error messages and codes it's giving. Ask if he's tried reseting the bios.

Say something about how it is very hard for you to offer help and assistance when the failure has happened after he took it to a shop and they've done something to it which has caused it to have 'failed'.

You're looking for him to say words to the extent of that it worked before he took it to the shop and after whatever they've done it now doesn't work.

A bios update and the warranty I think would be a no go because in my opinion it's quite clear that the shop have not updated the bios correctly and now don't know what to do.

I've had a few derp buyers open eBay disputes about something they've bought and think is broken, all of which have ended with me winning the case and the buyer getting it to work after (eventually) answering the questions I asked and trying my suggestions.

Once the dispute has been won, then you can report them for abusing the eBay money back guarantee. Mr. Green

Thanks guys Very Happy I have sent a message asking for more details about the bios upgrade and explained that it's going to be difficult for me to help because the shop is responsible for the issue. I asked if he booted it up before taking it to the shop. Thumbs Up

Putting no returns just means that people can't return in without however many days if they change their mind about the purchase. If something is borked then the buyer has every right to return it.

Removing cards from your paypal won't help stopping them being dicks about it, your paypal account will go into negative and then the threatening emails and letters will start.

The shop has borked it but unfortunately it is something to do with you cos you need to argue your corner to prevent paypal fucking you over.

This thread is a perfect example of why selling stuff on BCF is so much better than on eBay. Mr. Green

So that when eBay review the case they will see that he's engaging with buyer and trying to resolve the problem. Derp eBay buyers are pita because you have to waste loads of time responding to their stupid questions when they can't get it to work after they borked it somehow but what to blame you.

If he stops responding then the guy will be more likely to open a dispute and will be more likely to win it.

I'd concentrate on finding out in what way it has 'failed' and what error messages and codes it's giving.

He made a point in saying that it will cost £20. Fuck I ain't paying. I said he should speak to the first place and demand a refund / compensation from them for fucking it up in the first place. I can this going south fast Confused

The first shop should have flashed the bios when they updated it. Confused That's how you update the bios. Laughing

He needs to go back to the first shop and either get his money back or get them to flash the bios properly.
