So my girl has rolled backwards on a hill start and bumped into the car behind. She said he was pretty close. No damage from what she could see but obviously he's gonna be trying it on.

So legally, how close to the back of her would be counted as too close?

Yeah normally. No idea what's happened properly as I've barely had a chance to talk to her. Guessing its all going to be counted as her fault then. Although with no damage he'd be a cock to push it.

I always thought it was a fail of a test for rolling backwards. Not in control of the vehicle etc.

I wonder if she rolled back into him whilst he was still stationary or if he started moving forwards without paying enough attention to what your daughters car was doing so her car rolling backwards a very short distance was her only fault (which isn't really a fault as such).

Her fault as you are not supposed to roll backwards, hill starts were part of the driving test ages ago don't know if it still is.

Simple.

Unless theres video proof, if hes a cock and tries to claim just counter-claim saying she was stationary and he went up the back of her Mr. Green No proof either way and youve got nothing to lose by trying, best case scenario she actually wins, or he cops out and drops the claim. Worst case scenario nobody agrees and it goes 50/50, still better than a 100% at fault accident on her record Razz

she is at fault for rolling back but if there is actually no damage then there is no claim.

Rolling backwards would be a fail on a driving test.
In a criminal case it's driving without due care and attention.
When stationary the distance is irrelevant.

The usual distance to leave is tyre and tarmac, ie you can see the rear wheels and a bit af tarmac in front of your vehicle. But if she rolled back she is at fault.

Tyres and Tarmac is what I got taught too, but I don't think it's an actual rule, more just courtesy.

Minefield......A woman rolled back a couple of yards into my van one time in London, (she was texting, I was sounding my horn as she rolled back, she was fucking oblivious to it). Dozy bitch was out of the car and gobbing off in seconds. I was lucky there was a copper who'd seen it all and stepped in. I wasn't bothered as there was no damage to my van, just worried she was going to fuck me over for the whiplash claim. Once the copper told her she was at fault she came over all apologetic.
I was convinced that without the copper there, she* (and her 18 cousins, who were all in the car) would have had claims in for whiplash.

I don't know about legally, but when I learned to drive we where taught, tyres and tarmac.

you should leave a gap behind the car in front big enough to see their rear tyres and some of the road in front. when stopping at lights or at a junction.

it would be marked as minor fault on the test if you stopped too close.
