What are your thoughts/opinions/ knowledge on this?

How would it fare in other parts of the country?

Does that disqualify the 'loophole'?

What they do is put a warrant out for your arrest if you ignore it. Then you still get done when they catch up with you. Been there, done that Sad

They don't even need to do that. To stop people doing it they send a form S172 asking who was driving, if you don't answer satisfactorily (or at all) it's 6 points.

The statute hasn't changed since 2003. Is the case law for conviction under S172 because the form was unsigned, or conviction of the road traffic offence even though the form was unsigned?

If convicted.

If you were charged with failure to provide under S172, what if you turned up to court clutching a scan of a completed S172 form, a recorded delivery receipt for an envelope sent to the appropriate address, and an adamant assertion that you provided the details as required?

But doesn't the person at the counter effectively 'post' any item for which recorded delivery is purchased? I.e. they take the letter / package over the counter, stick the necessary label on and that's the last the customer sees of it?

What if that recorded delivery was just an empty envelope...
