Good evening BCF,

I received a letter today demanding the sum of £275 for parking at Get Geared in Leeds over two years ago.

At the time in question I had parked my bike (long since sold on) in a marked bay, went into the store, bought some tyre plugs, exited the store and then visited on foot the J&S store which is directly over the road.

When I returned approximately 5 minutes later, I found a parking charge notice demanding £60 or else stuck on my petrol tank by a company called UKCPS.

I went straight back into Get Geared and spoke with a staff member who assured me it would cancelled.

Two years plus change go by without hearing anything further and this drops through my letterbox:

Initial Googlings indicate these letters have gone out en masse to motorists around the country.

As I understand it the law recently changed so wiping my arse with it then posting it back is no longer the standard response to such barefaced Jewing money out of people and some sort of reply in writing needs to be made.

Can you guys offer any advice? I think going back to Get Geared tomorrow and asking them to intervene might be a good place to start?

How do they know it was YOU.

You are the registered keeper but can they show you were the driver with whom they have a contract?

That's a good point but these guys may well have a photo of me minus lid leaving the carpark so can't rely on that defence should it come to court.

I know they take photos from having worked on another site where UKCPS turned the carpark into an extortion factory.

The law has changed recently but this is 2 years old? Are they now able to get all the old tickets out from years ago and start hassling people for them? Doubt it.

2 years ago??? I don't think the more recent change in the law can be retrospectively applied to 'offences' that old. I'd ignore it.

I'll cut to the chase: the onus is on them to show that there was a contract, the exact terms of it, and how it was breached. Oh, and also who they are, their relationship to the landowner, and their standing to initiate an action for breach of contract.

It's not up to the OP to start listing all the things that he did or didn't do in case they might happen to be relevant.

Isn't j&s next door to get geared? Shared carpark between them and I think a maplins?

Does that mean that if I go to a retail park I need to work out which spaces belong to which store? Absurd much?

Watching with great interest and not going to get geared again until I find out how this pans out.

No, you're thinking of the Hein Gericke that closed down. J&S is directly opposite but at the other side of the road.

Before I get any more annoyed than I have to I'm going to call into Get Geared tomorrow and see what they have to say for themselves.

I'd do as Roger says and get on pepipoo. I'd also be contacting the Get Geared just to try and get them on side as well, not that it'll make all that much difference if the car park policing is contracted to an external company but it can't do any harm.

J&S is no longer opposite, it's actually in the old HG unit. So you have Maplin, Get Geared and J&S in a row.

What matters is the land owner, which could be any or none of the shops. It's unlikely to be the parking ghouls but if it goes anywhere you will want to find out as they should be able to instruct the ghouls to cancel proceedings.

Oh, as money is being made from that "free" parking area, the local council planning and rates boards might very well be interested if you want to stir a bit.

They seem to have got you for leaving the car park.
FWIW there was a landmark judgement about that (I didn't see Rogerborg post about it, he may have done in the past). It appears the parking company has to have the agreement of the shop(s) to impose the fines.

Anyhow, see here and here for an overview of the story.

It was also mentioned in this thread with a pdf of the judge's comments. Worth a read Very Happy

As it was 2 years ago I'd think the law changes don't apply.

Also IIRC that car park serves a number of shops. Two years ago might even include Hein Gericke (when did they go bust, resurrect and die again?). This parking company would have to have had agreement from all of them Thinking

Shit I ALWAYS park there and nip into town. This missus has recently copied that habit. I might have to tell her to watch it now.

I've noticed more recently they have put up a new sign which is cleaner than the last one but the writing is still stupendously small. If I got a ticket I would argue that the car park is never full, therefore I have created no loss to the businesses by deterring a potential customer.

The judge's comments are absolute gold. Judge tells the representative for the parking control company that she can't pursue any such cases on flawed premises and adds:

"If there is another case in the Scunthorpe County Court, Grimsby County Court or Hull County Court live by four pm on Friday, you will be coming to see me and I suggest you bring a toothbrush. Am I clear?"

And then:

"If you have issued proceedings and you have obtained judgments and those judgments are flawed, you have got to set those all aside. Not a good day at the office, is it? Do you wish to say anything else?"

Classic!

I suspect he was not amused by the arrogance of the company turning up in court without even a qualified solicitor to represent them.

So it's not a parking fine from the council? I'm pretty sure you can just ignore it. From what I've heard it's only the council who have any power to enforce a parking fine.
