I'd be annoyed if my info was sent out and I was blatantly blagging a dodgy whiplash claim for the insurance monies.

I'd change solicitors and report them to the Law Society, gross incompetence. Giving out your medical records to complete strangers is about as bad as it gets.

Other blokes surname is the same as mine

And my assessment was an hour after email was sent I've since noticed Laughing

Mine will hopefully turn up within two weeks

Guessing if you change during a no win no fee you have to pay for work already done

+1, I've stuck with a certain solicitor since I felt mugged essentially by another.

Ah. I sense a nice backhander coming your way to keep quiet.

If you have contact details for the other person. Please tell them as they too will not want to miss out on the compensation for a massive DPA failure Twisted Evil

Get it reported to everyone you can...

If they don't have much to say, you could always say how you're extremely concerned about the possibility your own information been sent elsewhere and may be left with no option but to report it to the ICO https://ico.org.uk/concerns/handling

Might make them a little more pro-active Razz

I'd report this to the ICO. It's a very serious breach of the Data Protection Act.

And as always, stress that this needs to be handled as a formal complaint, which is the first step to the Legal Ombudsman and SRA.

This is not an "oops, silly us" matter, these fucksticks had one job to do...

Yes, it is a PITA but apparently you must play fair with a straight bat and not make work for the regulators give the solicitor(s) a chance to fob you off.

So how much did they offer you then.....

How does only her having access to your records stop them being sent to the wrong person Rolling Eyes
But how many people have access to your email address... Clearly more than her. Or you would not have got someone elses details.
Or she is lieing to cover her backside Embarassed

TBH. I would be more worried that only one person has access. Should she go off sick or such. Who is going to deal with your case....

You are being far too nice. This needs raising a lot higher and sorting. Next time it could be your details....

Escalate it to one of the partners.

I don't believe for a second that only one person has access to your records! iooi says what if that person was off sick, I say what if that person died, quite what would happen then? Laughing

They're telling lies to try and fob you off!! Don't let them fob you off!!

As Roger says and map gives more details of, this needs to be handled as a formal complaint. Cut to the chase, you're not interested in being told the person who sent the e-mail isn't in the office today, that's besides the point and doesn't change anything. Your complaint needs to be made in writing to the solicitor handling your case and copied to the partner who's involved in your case.

By all means post a copy of your letter on this thread so people can give any feedback about anything that should be added or removed. If you do this, do of course remove anything that identifies the individuals or the solicitors involved because I expect you don't want them bawwwwing at you claiming that something you've posted is libelous.

Had an apologie off the person who sent the email

My report won't be ready for two weeks anyway

Also don't really see the point of a complaint as they haven't done ME any wrong

That's just me getting someone in trouble for the sake of it

Not only that do I really want to piss the people off thastcare getting me money

Why report somebodies bike being stolen? I mean, they haven't done ME any harm, that's just getting somebody in trouble for the sake of it.

That you know of.

The person whose personal medical records you have doesn't know it either.

My initial point was that you might want to pick a different clusterfuck of clowns to handle your case. Yeah but lulz m8 first names is dead hard and that.

Why on earth would you stay with these solicitors? Confused They fucked up like this, what makes you think that they won't fuck up part of your claim?

It's not getting someone in trouble for the sake of it. They fucked up big style, would you be so unbothered if it was your medical report that they sent to someone else?

Change solicitors then follow what Roger and map have outlined. Thumbs Up

Don't let them fob you off!!

Holy shit, if I were the bloke in Barnsley I'd be fuming if I was aware of this!

You should name and shame the buggers to make sure we can avoid them if ever the need arises to use one, although I'd understand your reluctance to do this now.

Unbelievable incompetence...
