So I was pootling along today on delivery and I was on a main road. There was a side road joining the main road on the left hand side, and a car was waiting there. I assumed he had seen me because he hadn't moved at all during my approach so naturally you'd think he wouldn't then pull out right in front of you. Wrong.
So he pulls out infront of me, there's a car on the right hand side of the main road thats gonna turn into that side road and so I decided not to swerve and hit him, and instead grab a fistful of front brake and lock the front at what I imagine was 20-30mph. When I felt it lock I think I must have dived off the bike or something cause I saw my hands infront of me and I went off to the right as the bike went left.
Anyway I fell off, got up, car drove off quickly, BMW driver behind me saw everything asked if I was okay and all that, surprisingly he was the only person to get out of his car to see if I was okay, other drivers seemed to just sit there & watch me pick my pizza bike up.
I have a sore right knee, nothing else hurts though so I guess I was lucky. Weirdly it wasn't all that scary, I just had this crazy adrenaline feeling and couldn't stop laughing nervously before then calling my boss and pushing my bike back to the store (was only up the road anyway)
My pizza bike is not road-taxed, it ran out on the 30th of last month. It's a worrying thought because if I actually hit that car and they were going to put this through insurance and all that bollocks, legally that bike shouldn't be allowed on the road so I'd have no leg to stand on? And what would happen to me if I was riding that bike not taxed, am I liable even though it's the company's bike?
Something was out to get me today anyway, I slipped and fell on my arse later on during another delivery lol. At least the pizza didn't go everywhere like when I crashed though. Fucking terrible day to say the least, I hate rain.

Also good to know you're not broken.
With regards to the bike, yes, you'd be in trouble probably for it not being taxed.
BUT, tax, or lack of, doesn't absolve the insurance company of their obligations to pay out to 3rd parties. I don't think.
If your insurance are obliged to pay out when the uninsured new owner crashes and you never cancelled the policy, then I'm sure they're obliged to pay out regardless of tax or MOT.
Just because you didn't hit the car, or the car didn't hit you, it doesn't mean they are not a part of the accident. If you pull out on a biker and that causes them to crash, you are a party involved in the accident even if there is no collision. To drive off is an offence.
If you had been injured, or swerved and hit an oncoming car and were seriously injured, then this would have been a very serious offence on their part. ____________________ Current Bike: 1999 Honda CB600 FX Hornet

The pizza was not okay
Here's the best I could do for a paint diagram, probably very out of proportion mind!

Red car is the one who waited forever, then suddenly pulled out on me, orange car is the car i didnt want to hit by swerving, X is around where I hit the brake hard, green person is me, blue is bike.
I honestly don't know how I ended up flying off the bike the opposite way to the way it fell.
Thanks for the info Llama, so that means that driver is a dick for not stopping, and I should hassle my boss to get the bikes taxed. I'm kind of worried that they aren't even MoT'd because half of htem are in such bad condition. To be honest I'm glad he didn't stop because I was very angry in the moment, I don't think he would've been able to reason with me.
The condition of the bikes, one of them has a throttle that seems to be stuck wide open because when you start it it revs like mad and nothing stops it. Another bike has a rear brake that sticks. Another bike the clutch doesn't even grab at all so you can rev it like crazy and it moves a couple centimetres. Electric start is knackered on most of them, some also have a non-working kickstart. Other bikes have wiring problems, indicator problems, and battery problems.
Think I might move to the place up the road (literally 10 doors up the road)- They've got brand new 2014 scooters, far better uniform, and pay 50p more per hour. |

Because if the old tax disc expired BEFORE October then it should have been re-taxed with a new disc.
It is not your responsibility to tax them if you are not the registered keeper. But it IS your responsibility to make sure they are taxed (or to take reasonable measures to ensure it is taxed) before you ride it on the public roads.
So in the absence of a current and valid tax disc, asking the manager or company owner if they are taxed and being told that yes they are, that is a reasonable measure on your part.
I imagine there should be a vehicle log I'd have thought, which will have relevant details such as tax expiry date, MOT date, perhaps insurance certificates etc.
Aside from the fact that you are liable for the vehicle you drive/ride, to ensure it is road legal, it is self-preservation.
If the bike has brakes that don't work... or tyres that are way past needing replacement, then for your own sake don't use it. If the manager tries to force you to take it then there are plenty of people you could contact who would be interested to hear about that. But even if he just sends you home instead because there aren't enough bikes, going home is a much better option than going to the hospital with broken bones or worse. ____________________ Current Bike: 1999 Honda CB600 FX Hornet

Even if it's not, that's no reason for not reporting an accident, you have reported it to police haven't you?
Usual thing, any CCTV, witnesses etc?
Careful with the knee, I had a sore right knee, 7 months on I've still got a sore right knee
Also with regards to company vehicles, refuse to take the dangerous ones out, particularly as they're bikes... it's your life after all. I do that at work, I don't take vans out with broken mirrors or bald tyres, ends up in a massive argument but I normally get my way. ____________________ Yamaha MT-03 '08 (crashed)

Well I know people who have had the police find CCTV after an accident, and they at least attempted to do the same in my case (even though I knew there was none).
In Meef's case I would at least be checking for CCTV myself. With no witnesses details your going to struggle anyway, but for all you know the driver could have reported it afterwards (like what happened to someone else on here). ____________________ Yamaha MT-03 '08 (crashed)

Street view? If it was a high street the chances of it being caught are (obviously) higher. There might still be a random spy cam' you can't see on street view, or outside someone's house. ____________________ Yamaha MT-03 '08 (crashed)

Haha I kind of wish I did hit the car now, would have been better to hit him than just fall off like a twunt
Always seems that much scarier to hit a hard thing though, this felt more like a bicycle crash back when I was mountain biking and jumping off things, you just hit the floor and slide a little. Actually I think I've hurt myself worse on a mountain bike, I never had the protective gear 'cept helmet. |
