Hey everyone.

The unfortunate happened to me on the 18th. Was knocked over by a lorry type thing are without indicating. Here's the video.

I know what some people might say. Maybe i shouldnt have overtaken on a junction i understand that and some might not of filtered full stop. But there was a huge traffic jsm(ish) and i thought filtering was best. .I honestly throught it was safe.

At 1st i didnt feel any pain at 1st as you can see i got straight back up, but oncr the adrenalin wore off i started to feel pain. I went A&E and saw a 1st year graduate who didnt feel my pain was worthy of an xray so i left with pain killers. Roll on thursday and was in agony. I decided to go back to the hospital after seeing my ankle has swollen like a ballon. Spent 5 hours there and once they looked at the xray they saw a small fracture and also feel there's a lot of muscle/ligament damage whatever it's called.

I was recomended by the dealership i took the bike to to claim through McAms rather then ny insurance to which i have. They gave me a courtesy bike snd will be replacing my heltmet.

I got Doble motorcycles to do a damage assessment and thry have quoted €1.850 to fix and i paid £1.300 for the bike so guessing write off. Waiting to hear from them as they sent an "engineer" to assess thr bike and should hear back soon.

So there you have it. I now have to wear a leg support for 6 weeks ish and have been sdvised to submit a personal injury claim. Which i have. Hope it was an ok read.

Cheers. Ive gone through McAms who specializes in this. Theyve given me a courtesy bike which is a scooter so i don't have to use tbe ankle and already replaced my £200 helmet.

Just filled out thd personal injury claim side of things.

Poor obs and 50/50.

You should always expect traffic to turn into a junction, especially in slow traffic when people decide to take a short cut.

He should have indicated, you shouldnt have overtaken at a junction.

I think this I'm afraid.

I know that he shouldn't have pulled across without looking, but there's no point being in the right when you've just been squashed by a lorry. You need to assume that shit like this is gonna happen.

I will be very surprised if liability by the other side is not contested and you will have to accept a large degree of contrbutory negligence I am afraid.

There is too much case law on these type of filtering crashes working against the rider unlike conventional filtering cases where the case law works in the riders favour.

You may be lucky and get away with splity liability of 50/50, but based on experience I can see the other side contesting it and I have seen these identical cases settle 80/20 against the rider.

Be prepared for a long drawn out fight, and given that you will be on the fast track scheme with fixed costs, your representatives are not going to fight your corner that hard unless it goes to trial in which case it will come out of the portal and go into multi track when costs will be uncapped to allow them to fight it on your behalf.

Just looked at a few of your videos and you are a truly terrible rider, I have no idea (except that you live near Croydon) how you passed your test. Hope the other sides insurance company don't look at your videos, it will affect your pay out.

You may want to check that if liability ends up split do you end up having to pay for that rental scooter..... its daily rate may be shockingly high.
