So I had my first accident today in nearly 3 years of riding! Very Happy

Big black car sideways in road, didn't see him till too late due to him not having any visible lights. I went for the small gap in between the front of his car and the parked cars but he didn't see me and was doing some maneuver(possibly 3 point turn...), he slowly moved closer to the parked car and caused me to be pinched.

I couldn't go round the right as oncoming traffic and didn't want to go into the side of him so went for space as after trying I realised I wasn't gonna stop in time, actual collision was only about 15mph so I kept the bike upright and got away with slightly bruised, crushed, sore knee.

I am in blue, he is pink... and collision is green.

In this a simple case of I should be able to stop in time therefore my fault?

You should have seen him and been prepared to stop seeing as you noticed he was carrying out a manoeuvre.

Thanks, only suffered a bent crash bung as the bung made the dent on his car.

And I didn't see the car until it was too late, and then I saw it was some maneuver, dark with side on car that is black with no lights i could see, I know it sounds stupid but i honestly didn't see him till it was too late.

It's generally the person doing the manoeuvre that is at fault, but it sounds like you probably could've avoided it if you had been on the ball, as you say he was moving slowly and you didn't see him in the road at first (I find it hard to believe he was completely invisible Wink), nevertheless you'll probably win the claim if you make one. I wouldn't word the insurance claim how you've worded it here, mind - you don't need to lie, but there are different ways of wording things.

Sometimes putting too much detail can hang you - you won't need much more, unless you can think of something that makes you sound good. If it doesn't help you or make you sound good, leave it out or reword it. Smile

EDIT:
If it helps I didn't just clip the front it was more of a scratch down the side... his car was probably rotated slightly more clockwise than my drawing.

What insurance cover do you have, TPO, TPF&F, Fully comp etc. Legal cover?

Have you had any contact with insurance yet? What was said?

Do you know if he's trying to claim off you yet?
Roughly how much damage has he caused to your bike?

I have TPFT

I have not contacted insurance yet
I pretty sure he will be trying to claim off me
Not a lot, crash bung bent and then marks down jacket arm.

As he's claiming then you're quite right, you need to give your version of events to your insurer pronto. Tell them confidently and adamantly that you reject any blame and wish to make a claim yourself, see what they say, they'll probably send you paperwork to fill out after asking what happened over the phone. Keep it sweet: none of this "He was in the road and I did not see him" crap Wink You were riding down the road, he pulled out, boom.

If you're TPF&F without legal cover they might say sod off to helping you claim, but they should still be interested in rejecting his claim. But you might find they help you anyway.

Legal cover makes it more likely they'll help you with your own claim IME. So probably a good thing to have. Smile
(Bear in mind some insurance companies always will be shit, no matter what options you have, and sometimes you have to put in some fight. You'll just have to see how it goes. Smile)

No, the speed limit is 30 mph. The safe speed isn't necessarily the speed limit. It can be lower

That say the OP saw the car, saw it start to move and failed to stop in time....

OP has already said he did not see the car.
Keep the statement to the truth and NEVER say what you thought the other driver was doing.

Given OP's stated Laughing speed. Which quives a quotes stopping distance of 7.5 cars..... He could not stop....
So one can only guess it was foggy and there were no street lights Embarassed

Just because you can see a car start doing something dangerous and stupid doesn't mean you are at fault for not stopping, otherwise there would be NO non-fault accidents, ever.

Obviously OP was very close to him when he pulled out. Otherwise he would have been able to stop, right OP.
