I bought a car off eBay (no problems with it all ok), gave it a good clean out and found a pair of earrings in a suede pouch under passenger seat.
I had to travel a fair bit to get the car, car was by Mitcham Junction and me in Wolverhampton, so it's not like I could jump in the car and drive around to her house to drop them off.

Rang lady and said found some earrings, she asked me to describe them and I did. She said just post them to her no worries, I did just that. Normal postage in a jiffy bag. She is now saying she never received them and in fact they were a 50th birthday present. Now states they are worth a couple of hundred quid and wants me to cough up.

I've told her to go gas herself and I'm paying nowt, by this time she's really fuming and I mentioned something along the lines of "Aren't you lot supposed to be Jolly!" - she's rather rotund. Rather childish I know, but she's getting on my nerves now. She now states she has my eBay address and the address off the log book that I filled in, mentioned she's going to sue me in a county court for the price of her ear rings.

Bit worried tbh. Need I be? Can she actually do that? she agreed normal postage and not recorded at the time. I never recorded the call or had anything in writing, but I did confirm on an eBay message to her that I'd posted her ear rings.

So as per title, what to do?

Thanks folks, feeling slightly better now. Can't really afford to cough up a couple of hundred quid right now so soon after Christmas anyway.

She also states he has some mates in Tipton (not a nice place about 5 miles from me) and I'd better cough up or else.

I'm no expert but my guess would be:

You bought what you saw, she sold it to you. Therefore the entirety of what you drove away with is your property. The fact that your earrings, which you offered to give back to their previous owner, went missing in the post is just bad luck. I can't see that she can do anything about it except pay to look stupid in front of a district judge.

Ignore. As soon as she satrted being threatening, she lost any communications privilages. Keep records of any communications they send but don't reply.

If they want to take you to court, my thoughts would be to see them there, which wont happen, explain what happened and recount the way they've dealt with it.

It was pretty stupid of her to have left the earrings in the car; we all make dumb mistakes and if you were nice enough to allegedly send them back in the post, then she probably should have let it drop and chased the post office instead. But then, if I were her, just cos you called me a fatty and regardless of whether your teutonic bird can crack walnuts with her eyebrows wouldn't really have put me off my course of coming round your house in the middle of the night with a can of petrol for insulting and laughing at me for no apparent reason other than you are childish and ignorant.

But that's just me *shrug* ...said previous owner of car/earrings will probably just act like the usual idiotic chav type, scream and shout a lot, and get nowhere. Serves her right, really. I bet she'll check more carefully when she sells her next car
