How would someone find out if someone else is making a claim against their insurance and how long does the person making the claim have to make a claim?

Your insurers will contact you if someone else's insurers contact them.
I should imagine that if anyone has a claim against you then they will do it as soon as they are able. Otherwise I would presume that they'd be limited by the 6 year limitation statute.

How does it work if both parties think the other is at fault?

I have made a claim against a driver but I will be surprised if he doesn't say it is my fault, going by his reaction at the scene of the accident.

When will I be told if he is trying to claim i.e. if there is any chance I could loose my NCB

On from that, how many years would I loose
at 1%, 49%, 50% and 51% my fault?

Your insurers will tell you if there's any dispute to liability. You should be asking them anyway, as presumably you've laid out your excess and you'd like that back?

If you are found even partially at fault, your NCD will be stepped back in accordance with the scale published in your policy wording - assuming you didn't protect it.

Is it not also the case that you can lose an unprotected NCD even if there was absolutely no fault on your part? Which is why I understood it to be better not to inform your insurance company for small 'knock-for-knock' incidents where it is likely that neither party will do anything about it. Even if they don't hit your NCB you'd probably find your premiums for next year rising 'just because'.
General rule of thumb is to expect that an insurance company will try to make more money out of you/pay out as little as possible if they think they can get away with it. Best bet seems to be pay your premium and avoid any form of contact (as is possible) with your insurer until your next premium is due!!!

If you claim on your policy and there's not an at fault third party to recover from then yes you'll lose no claims.

It's not a 'not at fault claims' bonus it's a no claims bonus.

No excess payed as it's TPFT.

Basically he was pulling out/doing a maneuver that casused a collision, firstly, who says who is at fault first, him or his insurance company on behalf of him.

And then if it is found to be any part my fault, that means I loose some NCB?

If he admitted fault at the scene it would certainly be worth mentioning it if you need to pursue a claim. Did you incur no damage to your bike/self because if you did you need to contact his insurance company asap (if you've got legal cover this is when you'll be needing it, as your company won't give a hoot if you've incurred damage)

He did not admit liability unfortunalty, too much of an asshole to do so.

I have told insurance company etc... and are pursing for personal injury(sore knee and shoulder), time off work(one day) and bike damage (bent crash bung)

Ok and what do they base their decision on, do they look at police statements etc? Because I gave a shit police statement, I wasn't fit to give one, I was in shock and I think it will damage my defence?

I should of declined one, lesson learnt.

Regarding NCD, as arry said it depends on the insurer. With MCE I believe 2yrs and under you lose, and that's with any liability against you.


I used to fill these reports out and had to have them at the correct department within 48 hours i think. Why it takes insurance companies months to get them is beyond me. It was about 12 pages in total either in A5 or A4 if you were doing awesome paint diagrams.

I ran into the back of a woman about a week ago, she left the roundabout then stopped dead in the middle. No damage but im expecting a three person whiplash claim any day now.

That'll depend on what the potential bill is.

There's statements given to the insurance companies by the parties involved. There's statements given by any witnesses. There's whatever physical evidence there is. There's the police report. Etc etc etc.

A crash I was in, the insurers wanted the police report before they were prepared to admit liability. But before liability was admitted the insurance company was making interim payments. Make of that what you will.

How long do you think it will take for the guys insurance to get back to the claim form sent to them. My solicitor is quite prompt with emails so she should let me know when they get back to her. How long do you think?

In this case, probably not long. The third party owns a swanky Range Rover and won't want to be cruising round with scuffs and dinks that he can get someone else to pay for. The likelihood is that he probably doesn't search for the cheapest online insurers who are reluctant to get into action.
For a definitive answer you'll need to contact Russell Grant or Mystic Meg, this is insurance companies that you are dealing with!
