I started an insurance policy on the first of July 2004. 8 weeks later I was knocked off the bike and it was written off. The blame was put 100% on the car driver.

I've now passed my test and have recieved all the other pay outs for my bike/kit/injuries.

I just rang Bennetts to ask about a quote for changing my bike on the policy I took out last year (1st of july) and they said they can't do that. So I asked how much I can get back if I cancel the policy. Again they said they can't do that.

Is that right? Sounds a bit off to me. Don't quite understand why I should lose the policy because someone knocked me off my bike.

If the price is higher ask them that this is unfair trading, did Bennets replace the bike? If so, then you probably have a point.

Did you buy a different bike? You probably will not have a chance

My understanding is the policy would be automatically cancelled once the payout was made.

You'll need a new policy for a new bike and declare the accident when you get a quote.

Yea, I'm pretty sure i'm not getting any of the money back. Just seems a bit stupid really. If it was my fault and I made a big claim, I could understand them not carrying on with my policy. But as it is, I've done nothing wrong, the other drivers insurance has paid for all my losses and compensation and they've paid for legal fees. So my insurance company aren't worse off.

Where does the 700 quid I paid for the policy go? That's the main thing I want to know.

Hmm, maybe you should get in touch with some higher authority within the firm? I wasn't happy with the legal service that I was given under my insurance policy, so I wrote a letter and followed it up with a phone call. Within a short period of time, the MD of the legal representatives was involved, as I was given alternative options.

They're likely to fob you off with some story if you sound like you don't care, so ask about it. Don't resign yourself to losing your money until you have explained your situation fully, and have had everything fully explained to you. While you're at it, maybe take a look at the terms and conditions of your insurance policy, there might be something there...

Whatever the company say, you have the right to complain to the Financial Ombudsman Service if you are unhappy. However, you do need to be conscious of time limits if you wish to complain to FOS.

When I changed my bike I had all sorts of problems with Bennetts as they said they can't (or wont) upgrade my policy to cover the new bike - the policy would have to be cancelled (with loss of premium) and renewed.

They gave me the impression they just couldn't care less.

Ended up telling them to stuff it and went elsewhere.

Hi

Cancelling policies after a claim is a common scam, but as you have not claimed from your policy then this sounds unlikely.

Sounds more likely that the policy is with a company who will not insure you on a bike larger than a 125 and you have now (after almost 7 months) got to the point where you get nothing back should you cancel the policy.

Pretty scummy attitude from them really.

They will insure me on a bigger bike (as a side note it's really expensive so I wouldn't want to). The problem is that they say I can't just change bike or cancel the policy, i've simply lost the policy. No refund at all because of the bike being written off. Now if they had paid out because of the claim, i'd understand, but it was the other drivers insurance that paid for everything. Really wanted my solicitors to deal with this that were dealing with the claims but they said they dont do that.

I suspect that although Bennets (a broker) will insure you on a bigger bike the actual insurance company who Bennets are currently covering you through will not insure you on a larger bike.

If they will not let you transfer the policy to another similar bike then I think you would have real grounds for complaint and I doubt that they could get away with it, but many insurance companies have restrictions on who they will insure on what capacity of bike. Not a great advert to the broker when they have arranged cover for you with a company that will not let you upgrade (something you might have been happy with but which they should probably have informed you of at the time).

hmm - my theft claim was processed recently and my policy was cancelled. Should I be entitled to the money covering the period up until my policy would have run out had I not claimed?

Dude that aint right??
That claim should have in no way affected your rights under your own policy.
Read the small print or find the insurance laws and quote it back to them. They can't penalize you for a non fault accident.

Depends on the wording of the policy but as you have claimed and they cancelled the policy probably not.

I had a total loss theft and the insurance company paid me but then told me that the claim had cancelled out any remaining policy, no insurance, no refund. I had about 6 months policy left (Carol Nash)

When I first got back into biking about 8 years ago my Thundercat was written off after only a month (I know - born again biker) and they replaced the bike with a new bike and the policy continued to run. (Yamaha insurance)

It seems fishy if the other company paid and they didn't pay you, check the fine print on your policy.
