Well, it finally happened.

After years of surviving dodgy weather and homicidal Volvos I finally got taken out this morning by a kamikaze pedestrian who thought it would be a great idea to run across a dual carriageway. Rolling Eyes

The bike's FUBAR'd, although I didn't actually fall off, but I have a broken right hand, torn rotator cuff and my right arm's an interesting shade of purple.

Sadly the pedestrian didn't fare quite so well with some nasty compound fractures.

Still, could've been worse.

It was the stupidest thing ever.

He ran across the road from right to left. He's going left, I swerved right to go behind him. Accident avoided, job done.

Or so I thought...

But at the very last second, just as I was about to pass harmlessly by him, he span around and ran back the other way - straight into me.

The twat.

Dunno about that. I suppose it depends on whether he's got any money.

Thing is, it wasn't a very salubrious area and if I've run over one of the local n'er do wells, there'll be little point in trying to claim off them.

I strongly suspect that you might be right.

Still, let's be realistic - my insurance is going to be fooked anyway so what difference does it make how much they end up paying out?

Unfortunately I don't know what you'd be claiming against, as most people don't have insurance for this sort of thing. You could possibly push a conviction though? He'd get at least ten minutes community service for that!

If they have house insurance you can claim against that as they have personal liability too I think. Failing that send an invoice, and then I guess you will have to go through the courts.

You're claiming against them personally. Same as if you had a crash in a vehicle. They carry insurance to cover the costs when it's a vehicle but the claim is still against the driver. You don't hear a court case of "Axia vs Norwich Union". It's "Jones vs Smith".

Send them a bill for the damage. If they don't pay, take them to court.
