Riding between appointments in work today coming down Canonbury road, doing about 20-25 in a 30, started braking where the solid line becomes dotted and got shunted up the jacks by a prick in a black BMW. didnt drop the bike, but came to a stop around 10-15 meters down the road and stopped mid lane to inspect the damage.
russian guy got out of the car and started having a go at me for giving way to the bus on the right of me at the roundabout. told him to wait there as i was going to pick up my number place. luckily as i was walking back to where the impact happened a random white van man gave me his card and said (in his opinion) the other driver was 100% at fault and gave me his permission to pass it over to my insurers.
I know the driver of the BMW saw me before he hit me as he "was just saying to his friend how good my bandit sounded" and he also admitted to looking at the bus instead of me as he approached the roundabout. he also said to call him when i work out the damage and he will pay me for it, so i am starting to think he is uninsured.. i have a (verified working) mobile number and his name and reg plate..
I've only been riding 3 years and never had to make a claim before, so i dont really know what to do.. i phoned 101 and reported an accident just incase my bodged back on numberplate fell off on my ride home, and as i was looking around the bike, i noticed that the back wheel doesnt look right, and the rear fairing is popped up. the tip of my exhaust looks pissed now as well.
i know its a bit of an old cliche round here, but does the subframe look a bit shortened? its also cracked the gasket between backbox on the exhaust and the tailpipe so my exhaust is now blowing like fuck.. theres a horrible grating noise coming from the back wheel as well, i didnt get a chance to phone my insurers yet, thats a job for first thing in the morning. same with phoning the police, my back is starting to tighten up now I've stopped having to do stuff all day.
problem is i need my bike for work, do i need to wait for the insurer to come and inspect it if i do decide to make a claim or am i ok to give it a poke tomorrow and try and get it roadworthy again?
like i said, i have never had to do any of this before, so any advice you guys have will be appreciated.

Firstly, check the plate against the insurance database. If he is insured then take your bike to a main dealer, get a quote, report it to the police and go see a doctor who can diagnose everything. There is no way someone driving a piece of shit car like that has enough loose change kicking around to pay for the damage.
He will just try to beat you down on price and screw you around. Dodgy Russians in crappy BMWs are a pain in the butt. ____________________ FZR400 (blown engine), ZXR750 (blown engine), ZX6R (accident), CBR600 which had engine issues after which I learned to change gear..., CBR900, CBR924 (stolen), CB600, CB1300 (everything blew up), BMW K1300GT (written off, hit from rear while stationary), Bandit 1250 for a couple of months, Triumph Sprint ST 1050 (nicked) and somewhere in there, I wrote off a Ducati 748 at Cadwell. |

I got rear-ended back in June,
Bike was physically fine but got it checked over - I dropped mine and cracked all the plastics up the right hand side and bent the crash bung
The hit from the car bent my exhaust (why yours has split the graphite gasket)
I also had whiplash and required physiotherapy
The insurance gave me cash to fix the bike, paid for physio and offered compensation.
I went through insurance as I needed a vehicle to get to work while mine was being accessed and repaired (if repaired in garage)
Unless BMW man is going to cover costs to get to work / inability to work due to incident then it's insurance job.
Speak only to his insurance company about the incident / claim if they're playing ball - inform your insurance but be clear that you're not claiming through them as you are discussing with the other party's insurance. You're informing them incase you need them to help argue the case.
You will get random phone calls from people who trawl hospital records for people who've been in accidents about compensation - they imply that they are your insurance company, take notes, agree to nothing and contact insurance company to discuss with them.

Have you got any of that in writing from the insurers?
I claimed for 3 claims totaling a fairly high sum, all non fault and my insurance has never been lower..
With regards to OP, get bike checked, speak to guy, inform of the price plus £50 to cover you fitting it, done.
Failing that, call insurers, grass him in straight away and use witness. |
I work for a car insurance company and we rate based on non fault claims. When I asked the underwriters why, that was their response. I would assume that also applies to motorbike insurance. ____________________ Biking history so far-

Well, unsure how they lower my premiums, along with 3 points.
I still am a firm believer that people spread this shit to scare people into not claiming because "you make my insurance higher nerrrrrrrr" argument occur.

Value's very subjective, I don't know how emotionally invested you are. But £1713 for a 19 year old high mileage cheap commuter sounds pretty darn good to me.

Oh, insurers, always with inventing laws.
The one thing I would do is make absolutely sure that DVLA know that you're not the keeper any more, even if that means just writing them a letter. ____________________ Biking is 1/20th as dangerous as horse riding.
