Half a million spent fighting the case so far versus a few grand on a dodgy character down the pub to address the situation, I know how I'd be spending my money.

Planet Law.

Would you rather that unelected judges made a habit of saying "Oh, sure the law says X, but Parliament probably meant Y" ?

Take it up with your elected representative. It's one of the very few things that they possibly still have a say in, until a case gets to Strasbourg.

Yes, but she won't get it if you can show that a full and final financial settlement has already been agreed.

That's this chap's problem, he reckons it was all done and dusted but he can't find the paperwork, and there's no time limit on it.

I did think 'wtf' when I read the titles - but actually it seems in the original divorce case he either didn't agree to it being a 'final' settlement, or lost the papers.

(Edit, beaten to it already by a few hours.)

Lost the papers and apparently there are no court records because so long ago.


Either way still think its a bit shit.



Makes the case for prenups, but then thats like saying you almost expect the marriage not to last.

I was never a fan of marriage due to the difficulties of cutting ties with the person in the event of a divorce anyway, but a year or so ago, I saw an article about a guy who'd won the lottery, and even though he was divorced for about 10 years, she was able to claim half that money. That was the final nail in the coffin for me.

Reminds me of the old Eddie Murphy Standup Tour RAW. "HALF!"

And all because they probably did the divorce on the cheap and didn't get it signed off as 'full and final'

AIUI, the gold digger, in this case, is still mining!

She has not won any money yet.
What has happened is, the supreme court have ordered she has the right to have her case heard in the family court.

In the judgement Lord Wilson said:-

"It is obvious, even at this stage, that an award approaching that size, (£1.9M), is out of the question"


Quote:
"Her claim may even be dismissed"


Doesn't make any of it right, but there is a more than a whiff of "meeja" hype at the moment
No doubt there are lawyers, behind the scenes, with £ signs in their eyes, fanning the the flames!

That's like saying you buy insurance because you expect to crash.

Rather you buy insurance, to cover your arse should some FUBARing event occur, despite the fact that you will obviously do everything possible to avoid crashing. Insurance turns a catastrophic event (having to pick up the tab for spazzing a schoolbus) into a ballache (lost NCB, length payout periods etc etc).

Seeing as statistically a good chunk of modern marriages will fail, I would see pre-nups as two people going into marriage pragmatically and with level-heads. As opposed to: "I will luv u 4eva an eva amen I sware to baby jeezus"

its all rather scarey, I decided to divorce my ex after having walked out on him 13 years ago, I left him with everything by the way.

I was told to rethink my decison as I could still go after him for money etc.

I was like erm I dont think so, just get this divorce rolling.

It's the 'extreme' cases that get publicised which colours matters sadly
