I had a crash about a week ago, no-fault obviously - he pulled out right in front of me no indication or looking. I didn't want to get in an argument with the guy, and originally wanted to exchange details quick:

I let him photograph my photocard driver's licence since its got most of my details on. Now he's got his insurance company making a counter-claim and is generally being a prick. Is there anything damaging he can do with those details on my licence?

Well he now has your full name and your address, depends on how much of a prick he wants to be.

For future reference exchanging details should only really be a name, a contact telephone number (check mobile numbers work there and then), the insurance company name and policy number. Also grab make, model and reg of the other vehicle. DO NOT GIVE YOUR ADDRESS.

What does his counter-claim entail? Did you get any witness details? Any places with CCTV overlooking where the incident occurred that could verify your version of events?

Also (and most importantly) hope you are OK and not injured Thumbs Up

Identity theft's a possibility!
He could go whining to the filth, claiming you were doing at least 150mph, whilst dragging many kittens along the road on the end of the, barbed wire, shackles attached to the back of your bike.

If you T-boned the side of his car, after he failed to give way, how can he be denying liability?

Unfortunately no witnesses or CCTV, I wish i had one of those helmet cams now. At the scene he was adamant that i had "gone into the back of him" and so it would automatically be my fault...despite the fact that all of the damage to his car was on the side and not the rear! I think his insurance co is just being cheeky. About an hour after the crash they texted me offering a courtesy vehicle, then he left a voicemail offering a deal whereby I PAY HIM and not go through insurance lol. Maybe they just want me to stop my claim.

I know not much help now but Helmet Cam....invest in one. This kind of situation is exactly what they've been invented for.

If someone pulls out, hit it and call insurance that day. No holding about. I called them at the side of the road waiting for police Laughing

Hope you are ok, but I would put your claim in right away, silly to have not done if you haven't..

Doesn't your phone have a camera on it to take loads of pictures of the damage..... helps with counter claims down the line, or buy a disposable camera for such times.

Anyway I got a cheap HD helmet camera from ebay for £35, the wind noise is terrible.... but at least the picture is good enough

Yeah i put a claim in, although i'm starting to wish i didn't - as they've replaced my bike with a crappy scooter that i don't really want to ride.

Took photos of the damage, but so far my insurance co hasn't asked for them.

Once I get the bike back i'm definitely getting one of those cameras, this has happened twice now.

Get on the phone to them now and tell them that you believe the other party is putting in a fraudulent counter claim that you hit the rear of his vehicle and that he states it is your fault. Tell them that you have evidence to show that the damage to his car is on the side of the vehicle after he pulled out in front of you. You would like to know who to email the photos to so that you have your bike repaired and returned to you quickly.

If possible save a copy of the message he left you, any future calls from him pass them on to your secretary, Ms Voicemail.

Potentially a bad thing to do!!

If you accept and sign for whatever courtesy bike it is, there's a good chance that you will be liable for the cost of that bike if your claim doesn't go successfully.

Go back to your solicitors and throw things at them, like the crappy scooter.

Amazing how quick you can go from 'phone an ambulance, all my bones hurt' mode, to chasing a Peugeot 206 up a main road in rush hour traffic. Personally I thank the lord and his associates for their respective swift miracles.

Why chase? Call plod and explain how someone witht the reg XXX just knocked you off your bike and left you for dead. Pretty difficult to argue liability if they are guilty of fleeing the scene of an RTA.

Isn't the general strategy for the other parties insurance in situations like this to just bluff, bluff, bluff, aim for court, don't bother defending, get a default judgement, but crucially a final judgement to stop any possiblity of the 'no fee/no win' leaches from making a future claim for zillions of quid in damages?

They know full well their client is liable, but what to ensure damages aren't too high and they won't have a surprise future claims.
