So I found this:https://www.ebay.co.uk/itm/Lexmoto-XTR-125CC-big-bore-150cc-learner-legal-registered-as-125cc-very-fast-/251944315565?pt=LH_DefaultDomain_3&hash=item3aa90d2aad

And was wondering if this is at all legal fro new riders, as it claims, as I've had my 125 stolen and if I can't get it back this seems like a pretty good replacement for the price.

It's "legal" because as far as the paperwork is concerned, it is still a 125cc bike.

It's been modified (engine capacity increased) so DVLA "needs" to be informed. And insurance company would also need to be.

It would no longer be legal for a CBT L-plate rider.

BUT, you could less-than-legally ride it and for the most part, DVLA would be none the wiser.
I wouldn't want to get caught on it though, punishment probably outweighs the benefit, after all, its not going to be that much faster than a 125 anyway.

Thought so, think I'll stick with looking at a second hand YZF or YBF in this case!

It's legal in the politician's sense of "Anything you can get away with". Might as well get a Hyosung GT125 and shoehorn a 250 or conceivably a 500 into it.

Item reported for the lulz, not that eBay give a stuff any more.

It is actually "very fast."

I read that in the listing.

And "leaner legal."

Ignoring the 150 aspect, the owner claims to have done the "invisible" servicing aspects - oil change, spark plug etc., yet hasn't bothered to fit the two indicators which will have taken him longer to describe than to actually sort out (assuming that they are the right ones to fit the bike, and the electrics actually work).

In itself, that'd be a big red flag to me about the general way that the bike is being looked after and "serviced".

If it's registered as a 125 it's not road legal.
Definitely not learner legal.
Insure it as a 125 and you're guilty of fraudulently obtaining insurance.

It is illegal, in terms of the paperwork, but the VIN on the engine says 125 and there's no way anyone could ever tell, just looking at the cylinder, that it's got 150cc. Thumbs Up

The worst case scenario is a copper with mobile DYNO, checking the power output and finding out, it's a bit more powerful than it should be. OR you could cause a major crash and they would take the engine, for some reason, apart. Thinking

To be honest it'd be highly unlikely you'd get caught and in the rare occasion that you do get stopped for a roadside dyno test, just rip apart the wiring so it wont start.

Little Known legal loop-hole, you know, for taxation & licencing, in the UK, the displacement is whatever the manufacturer declares it to be, when new; and does not require declaring to DVLA at 'rebore' provided that the engine stays within the manufacturers recommended 'service limits'..... On the small honda engines, I think they go as far as +2.5mm on 'standard over-bores' in 1/4mm increments; on the short stroke 125 twin, that gets you up to the 147cc of the '150' models sold in some eastern markets; on the longer stroke singles, could possibly let them get as far as maybe 170cc.

However, If its a big-bore kit, as opposed to having been 'bored out' at a local engine re-conditioners; chances are the barrel is stamped 148cc or whatever, and is the chinese replacement part for one of the far eastern market '150' models... which would count as a 'modification' not a 'service replacement', unfortunately.

Learner-Legal power limit is 14 & 1/2bhp at the crank; that will have one of the chinese copy motors in it; its an upright single and air-cooled, and i spotted a kick-starter so probably the suzuki DR125 SOHC copy, or honda XL125 copy, or the venerable old CG125 push-rod lump.. and about 10bhp at the crank if its a good'n.

The 'Big-Bore' kit, increasing displacement by 20% is unlikely to increase power proportionally; and even if it did, would still only be offering around 12, maybe 13bhp, still under Learner-Legal and A1 limits..

It's not a 'sales feature' I'd stick in an advert, or look for; tells you that the twit that's selling it, is more intent on going kwik and thrashing the knackers off it than looking after it, and has probably done untold ill to the thing with enthusiastic tinkering.. cos motor would have had to have been half rebuilt to fit BB kit, and what has he done to carb and exhaust and airbox and electrics..... and fact he's done anything to try and make a chinky quicker and probably even less reliable suggests he's not the most clued up mechanic out there to start with. You'd get more performanc &, more reliability much more easily buying a 'better' Jap-bike, and it'd probably cost less to do so.... so if this has been done on the cheap? Well, I wouldn't buy it! Irrespective of 'legality'.

It's a CG125 copy. Even at 150cc it's highly unlikely to make more than 11kW.

To be honest, it is an almost risk free 'crime'. Very few kittens will die.

We do not have L plates here, but the first 2 categories of motorcycle licenses are also limited by displacement.

AM (15 years old) - 50cc, max. of 45kph
A1 (16 years old) - 125cc, max. of 11kw

When on MOT, the technician checks the VIN on the engine and the type of the engine must correspond with the motorcycle itself.

I know it sound stupid but an example would be a ZX7R, there's xxxZX750xxxxxxxxx on the frame, and there's also ZX750 on the engine. That is how the technician can tell, if you've got the right engine in the frame. And a few years back, the paperwork had mandatory VIN for the frame and for the engine. Now it's just the frame VIN, because some smart people in the gov. understood, that older bikes eat engines a lot, so it'd be stupid to have to do all the extra paper work when ever you change the crank case. But still if I put a ZX9R engine into my ZX7R, there's no way I'd get MOT (legally).

Yes, we do get people on A1 licence with 160cc, or whatever children can buy these days, kits on their 125cc motorcycles. Thumbs Up

Front brake lever snapped, broken screen, no indicators, really scabby looking clocks, scratched panels and the chain looks slack. Shocked

Did these have a kickstart rubber?

Yes. It's doubtless been removed to save weight because racebike. Folded arms

Given his bullshit handwaving about the MOT (how can he not know if it needs one yet?) I expect that it's failed its first MOT, possibly because of the engine shenanigans, and the chap's trying to punt it on.

I'm seeing quite a few 2012 Whang Dong brands up on Gumtree at the moment, probably for the same reason. The Lexmoto looks like a bargain compared to this TMEC, an abandoned brand with no parts availability.

...then a few days later...
https://www.gumtree.com/p/tm-motorbikes/2012-tmec-enduro-125-can-be-used-on-and-off-road/1115227593

I texted the 2nd seller just for lulz:

Rogerborg: How long have you had the bike and why are you selling?
Jay: selling cuz got bigger bike
Rogerborg: And how long have you had it?
Jay: <no reply>
Rogerborg: Parts aren't a problem, are they? Should fly through an MOT, right?
Jay: <no reply>
Rogerborg: Was it something I said?

That's never a sign of anything, some people just buy a motorcycle and get bored of it or run out of money the next month. Thumbs Up

It's not a dead cert - but it's a good indication.

When looking for my 911 I'd seen 3 or 4 that the owner had only had a year or so - then the general maintenance items on top of a major service spend put them off keeping it any longer (but of course, they need a more practical car, are going abroad for work, blah blah). Why would I buy a car from someone that doesn't spend money on it when required?

Look again: two sellers, two locations, two dates.

I reckon the first chap has punted it on because it's failed its first MOT and he can't get parts. The second one has swiftly realised that his 'bargain' bike is a pup and now he's trying to offload it as well to a third sucker. This could continue for some time. Wink

Due its first MOT this year, and he's saying only the indicators would cause it an issue - yet hasn't put it through its MOT? IF I was planning to buy it, I'd want him to put it through the MOT first, and then I'd want to see the advisories and such.

Well, sure. He's clearly full of it.

So's half of Gumtree though: "bike will have a full year's MOT put on after sale", over and over.

Jog on. I'm not interested in buying based on what may or may not happen in the future.

TBF most cars don't need spending money (aside from the mandatory MOT/tax/insurance and the scheduled services) on that often, so someone who bought a car then realised 6-12 months later they can't afford the upkeep of the car isn't necessarily a bad thing.

There are many things that don't need fixing as a priority etc.

Or could be someone that realised they wouldn't be able to afford the £1800 major service bill in a years time.

Doesn't NECESSARILY mean the car/seller should be so quickly dismissed and a "better example" sought.
I say necessarily because there are the cases where people just won't spend any money at all and wouldn't even fork out money to top up the oil, never mind change it.

TM I'm not so sure I agree with missing out some of the 'very fast tuned innit' from such a sales ad. But yes I do agree that the way these ads are often worded or written does equate to skint kid with mega race bike fastest in 3towns because he won every race etc, would make you run a mile generally.

But, the key thing is (target audience). If you know who is the most likely kind of buyer to go for a specific type of machine, you can often get massively more interest from this maybe small section of buyers than you would from the general appeal to everyone marketing would.

It does not matter if it's a 50cc scooter, a Subaru Impreza, a 4x4 etc, if you target a specific kind of buyer, you can sometimes (not always) get a huge amount of interest from this smaller percentage of would be buyers.

Id did no harm with Iain's 75mph Chinqy Ped making the ad appeal to a certain type of buyer, and when I sold my old speedfight 100, I also wrote in the ad, Tuned engine very fast! I might have got less calls from Pensioners wanting a shopping scooter, or Barry the Brickie looking for a ride to work hack etc, but I still had loads of calls from the type of buyer I was expecting to hear from.

I'm not saying it always works, but there is something to be said sometimes for targeted marketing.
