I honestly don't see why not. Skin colour is an almost trivial distinction in comparison to innie vs outie.

The lulz here is more this broad choosing a race to further her career of crying 'race hate'. It didn't work when she was a cracker, so she slapped on the blackface and jumped ship to the NAACP, since that appears to me to be pretty much their raison d'être.

But again, the degree of "reassignment" is nothing compared to a ladyboy prozzie, and there can be deception there as well.

I think I'm coming down on the side of calling fair play, because if you can bully and blackmail folk into making special provisions for you just based on what you say your skin colour is, more fool them.
