Interesting isn't it. Had a bloke pull out on me today coming home from work, and when I pulled up next to him to let him know to use his f**king eyes he said I was speeding like a bat out of hell. Funny, as I was going under the speed limit. Makes me think about all these insurance claims going against motorcyclists, the blanket "he was speeding" is all too common. This guy didn't even see me, yet this was his first response.
Nothing out of the ordinary I know, had worst things happen the past couple of days but this irked me a little. I let the happy chappy continue on with his journey whilst I laughed waving goodbye.
Edit; Stupid typos as I don't preview my posts. .

It's a well reported optical 'allusion'; the 'cluttered' profile of a motorcycle lacks clearly defined shape, and being tall and narrow, the foreshortening of perspective means, that when viewed from the front, at a distance you are small and indistinct, and as you get closer you remain small and indistinct, through the middle-distance; THEN as you leave the middle distance, and enter the near distance, the observer can start to resolve more of the 'detail' in your shape, and you 'appear' to get very big, very quickly, which gives the perception, when you reach the observer, that you were a lot further away, when you were first seen, and were always traveling a lot faster than you were.
I think the effect has actually has a name, the '[something] Effect', and been mentioned in many conspicuity studies; where its been used numerous times to decry compulsory conspicuity aids like Day-time-Running-Lights or Hi-Viz vests, that may make an observer see you sooner... but in so doing, conspire to make them perceive you are further away than you are.
It's not necessarily a presumption or excuse, "You were Speeding".. THAT could have been what they genuinely saw and truly believe they saw you doing... ____________________ My Webby'Tef's-tQ, loads of stuff about my bikes, my Land-Rovers, and the stuff I do with them!

Cup holder and hammer springs to mind when such responses are given to me.
He didn't look, you know he didn't. His response was you're speeding. So, even if he did look, pulling out on a speeding motorcyclist is okay because he's breaking the law. ____________________ CBT: 12/06/10, Theory: 22/09/10, Module 1: 09/11/10, Module 2: 19/01/11

Thinking it is not the same as making a statement of fact that incriminates you.
I get what you're saying: we're all above average drivers and therefore it must be the other guy's fault. But it is useful to engage brain before mouth if you mash someone up, even if it's only a bloody biker. ____________________ Biking is 1/20th as dangerous as horse riding.

Not that I agree with him, but "I looked right and saw his car, which was by the bus stop approximately 40 yards away from the junction. I looked left quickly and there was nothing coming, and as I knew traffic from the right was so far away, I began my pull out. As it was a 30mph road I assumed he would be going something close to 30mph however it turns out he was travelling far in excess of that. If applicable: 'Just look at the damage!!1'".
It won't change the insurance result. I do feel that it's a slightly better explanation than "I just didn't see him" though, when the rozzers turn up and start considering a charge. |
Agreed, however when you look up the road and see an approaching vehicle, you should note its distance and speed to make a judgement on how quickly it will arrive. Making assumptions about how fast it should be going is admitting to negligence. You should react to the situation you are given, not what you think should be happening. If it's a bike, you should take an extra moment to be sure you have got it right because, as discussed, it isn't as obvious at first glance. ____________________

When I have had the "You were speeding" response I reply something like "you saw me and pulled out away? You tried to kill me? GET OUT THE FUCKING CAR." This usually changes their mind ____________________ Well, you know what they say. If you want to save the world, you have to push a few old ladies down the stairs.
