Hi I am brand new on here, only ridden 3k on my ybr125 till it got smashed up by a driver who pulled out on me.
Turns out he never did look right and he took his wifes word for it that he should pull out. I was doing 30 max thru a village on the otherwise great fun a267 from tunbridge wells south through Frant.

So my bike may be a write off due to banana forks etc. and I am hobbling about with a bashed up left knee. Besides that I am a bit sore and strained but hopefully will only miss a couple of weeks work.

Anyone fancy making a guess at how much compo I can get? The other driver accepted responisiblity and it is going through my insurances solicitors (fletchers)

Other points in reflection of the accident for what they are worth:
I was wearing a bright orange hi vis which was worthless as he never even glanced in my direction.
I hesitated to beep at him when I first saw him out of not wanting to be rude...
He pulled out right across my lane so quickly i had about 3m to stop, and I failed to use my back brake.
So I conclude I should have been more assertive with the horn and will be in future, I will have a louder exhaust on my next bike to make sure people hear even if they don't see.
And I will make sure my right foot hovers on the back brake any time I am near intersections, and train to get my responses as sharp as possible.

Any other comments?

No broken bones?

Bike, £1400 and injuries £3000 estimate.

I wouldn't mention those to your insurance company Laughing

Fletchers are useless in getting back to you though and take ages to do anything. Keep on at them.

Not surprised.

Big mistake, a beep on the horn can make all the difference, forget about the cager's feelings and put your own safety first.

Back brake is mainly there for low speed control and wouldn't have made much difference, you need about 25metres to stop safely from 30mph.

I doubt it will make much difference.

Don't, jamming on the back brake will reduce the nose dive on the front wheel, thus reducing how hard the front tyre digs into the tarmac, so you're stopping distance will increase, also you'll probably lock the back wheel which is no help at all.

when you say bike 1400 is that a guess at the bikes value or standard replacement cost? it is a ybr125 2010 with 17k on it

Insurers and that like seem to pay over the odds for vehicles. Like my ped was paid out after being stolen and was silly priced Shocked My 2001 125 in 2008 was smashed in to and I got paid £1095 for the bike, I paid £600 for it Confused

Book value. Thumbs Up

I personally would prefer to put all my concentration into braking, not sounding the horn.

If you're braking hard, I have no problem with sounding the horn at the same time if you find you have the mental space to do so. If nothing else, it makes potential witnesses look at you.

You don't have to go through solicitors, or even your own insurance company. You can deal direct with the other person's insurance company, this is particularly easy if the other person has told them about it and told them he admitted blame, or if blame is clearly obvious.

Dealing direct is quicker, you can get your payout in less than a week. They might not deal direct over the injuries, but probably will over the bike.

I think Paddy's estimation on the injuries is a bit high. It's easy to get 1000-1500 for just about anything - a gentle rear end knock and a sore back for a few weeks afterwards can get you a grand. More than this they tend to require medical reports, you will be sent to private doctor for an assessment. With no broken bones and just soft tissue damage I wouldn't be expecting much of a payout.

Remember to claim for your gear. Protective equipment is only meant to survive a single accident. It will work afterwards, but probably not as well.

All the stuff about how it happened, the other side not paying attention etc - that is only useful in establishing liability, it has no impact on the size of the payout.

I'd guess a grand absolute max for the injuries plus the current value of the bike. Payout should be fairly quick since the injury's effect will be predictable, with serious injuries it can take years as you can't tell straight away what the long term impact will be.

I'm running by the payouts I've had for a similar stance, to be fair I did break my thumb but got £5000 for that which even I questioned... Neutral

I got 4800 for a bruise and a painful kneecap for 3 weeks once.

As has been seen on many occasions (youtube videos) it's not always possible to reach for the horn in certain situations. When in the last moments before impact most people's first reaction is to reach for the brakes and/or concentrate on avoiding measures rather than letting the other driver know you're about to splat into them.

To be fair it sounds like you had little to no time to stop. Could be down to you not anticipating the car pulling out, or the car only became visible moments before impact.

Re hi viz, imo it's over rated. A loud exhaust and an attentive rider is much more useful in my view.

Good that you're OK though. Thumbs Up

I don't know anything about the insurance side of things, but as far as loud exhausts go, I think only the really loud bikes are capable of actually penetrating a cage and making people look. You're not going to get that from a 125. It might have some effect on pedestrians waiting to step out, but remember you have distance and windows and the radio to get through before it gets to the drivers' ears.

Loud pipes usually direct the sound behind the bike so I doubt it would make much difference.

If you were doing a smidsy manurvre you'd be half way on swerving out the way anyway.

Are you serious?

Seeing as you mention them, I was contacted by a guy today who had a crash and was handed to this firm by his insurers.

He suffered 4 unstable fractures to his spine, left ankle and foot pinned and plated, right arm pinned and plated along with other multiple fractures.

He was told that his injuries are worth in the region of £6,000 Shocked

So on that basis, your injuries are worth in the region of about £5.50.

In all seriousness, nobody can predict a valuation on an injury because there are many different factors that have to be taken into consideration, and no 2 injuries are the same.

Also much depends on the long term progosis, and how quickly you make a full recovery as each injury called general damages has a specific value depending on whether it is classed as minor, moderate or severe, there is also a payment for pain and suffering and then special damages which accounts for all other losses such as kit, loss of earnings and so on. Put the 2 together and this will give you the total, assuming that there are no deductions for contributory negligence

I nearly died at 30mph. Read here - https://www.bikechatforums.com/viewtopic.php?t=288578 27th Feb 2008 part. That was 30 max.

Be wary of putting faith in the idea that people will see you if you've got a loud can.

Wink

The driver might have admitted fault but have the insurance company admitted liability?

I got 3k direct from the insurance of the chap who shunted me from behind at a junction
Not sure if that was partly due to the fact I was going on holiday 3 days after the accident and couldn't pick my daughter up (not quite 1 at the time) so my wife had to cope with her + baggage through the airport (forgot to mention my in-laws were with us)

didn't do much but laze on the beach and swim in the sea in Mallorca in June for a week, came back to a decent offer for the bike, injury took a little longer as they wanted to be certain there were no other issues to arise,

thankfully they didn't settle injury quickly as I did need physio which they arranged.

I've just had a settlement of £6600 for a broken sternum and whiplash.

On the basis of my payout that lot should have been worth around £50k.

Is really impossible to judge.

Depends how well you heal, I crashed last April and am still being tested and such. Have now had four medicals with two doctors and a surgeon, a psychological analysis & am now told I need an MRI scan done to assess the state of damage to my knees as they'd expected them to heal up and be normal rather than deteriorate.

See how it goes Thumbs Up
