Hi all, I am just after a little advice.

I have received a letter from a company called RSA Claims stating that I'd been involved in an accident of some kind. They have also stated that they have dealt with a third party claim as per statutory obligations retaining right of recovery against myself in respect of payments.

This accident was supposed to have happened in 2012 but I didn't own a car in that year. I phoned the company to clarify that it wasn't me involved in this and that somehow my name had been crossed with someone else with the same name but with a different date of birth. The company assured me that it would be dealt with and that I would be cleared of this accusation.

However, today, I received another letter still claiming that I am the person involved in the accident and that they intend to pursue me for recovery of all payments.

How should I go about clearing my name?

Post them a letter citing the telephone call you made as well. Ensure you get proof of postage. Await response.

If it's not written down, it didn't happen. As above, write a letter to them, don't phone them. Then you can evidence that you've written to them rather than referring to a phone call that might not be (and probably wasn't) recorded.

Explain the situation and that you can provide proof of ID if required. Hopefully it should be fairly easy to demonstrate that you were nothing to do with the vehicle involved.

You can either completely ignore them until and unless a county court summons hits the mat, or you can try and sort it out.

If you choose to contact them again, initiate a complaint. Insist on it, don't enter into any other discussion.

If they keep harassing you, do nothing but refer to this complaint and tell them to resolve it.

After 8 weeks, go to the FOS.

Thank you, guys.

As I'd already made the mistake of contacting them, Roger, I am going to follow your advice and initiate a complaint. If I receive another letter then I will go down the route of FOS.

Sent my letter of complaint, within a week i received two letters.
The first which was an acknowledgement of complaint.
The second was an apology for contacting the wrong me.
