First off and feel sore...

Any chance I can make a claim against the van? Didn't indicate (or look for can be seen).

Probably not. They didn't hit you. As far as they're concerned you just fell of your bike behind them.

When there is a gap like you have there I tend to fill it for this exact reason it gives you more space from people trying to move out and gives you better visibility.

Still you live and learn. (Don't you?)

Claiming is worth a go, I'm not sure you will get anywhere, but if nothing else it'll make the driver aware and might make him look twice next time.

P.S. well done for making a youtube video the appropriate length for the content, it's a rare gift.

The roads were that annoying damp but not raining situation.

I was thinking of going into the right lane as the left usually get jammed up, I was maybe too far to the right (not something I tend to be Wink ).

I'll try and take it easier next time... The lens makes it look further away than it was, but some indication would of helped me know he was going to change lanes.

I thought so at first too, but on further viewing I believed it to be reflection/glare off of the van's numberplate.

There's a chance.

Do not go via your insurer, they have no interest in it other than recording an accident that you'll have to declare for 5 years.

Document the damage and your injuries, then speak to:

https://www.whitedalton.co.uk/
https://www.mc-ams.co.uk/
...etc...

Might not even be worth their while taking it on though.

Best of luck.

It seems like that slid way too easily, what's the front tyre?

Sliding aside, it doesn't look like you can make out the licence plate from that video, you'd probably have some luck through the MIB.

Not sure it'll actually be worth your time mind, my claim with the MIB is still going on over 2 years after the crash.

Could do with more of the run in. 5 sec's gives no indication of traffic before.

No way of knowing if the van driver looked.....
Did not indicate, but only just missed the back of the car in left lane. So my guess will be he had checked before and was concentrating on making sure he missed the back of the car.

Also I bet OP was hidden by the lights of the car behind. One reason I really hate vehicles running with headlights on in conditions like this. Far too much gets hidden by the glare of the lights and reflections off the road.

I bet if OP tries to claim they will argue he was going too fast up to the back of slowing traffic.

For the chances of success (minimal) I wouldn't risk the chance of having an accident recorded, with the associated premium hike.

If I was a betting man (and I am) I would chalk this one off to experience and suck up the cost

C'mon BCF, I am much disappoint.

OP - Had the van not pulled that manoeuvre, were you planning on caning it into the back of the car in front instead? Traffic had obviously already slowed up as it has barely moved on after the downing.

Unlike Northern Monkey I am not a betting man and I'll eat one of my many stinky baseball caps if you get anything other than a snarky letter back from the van's insurance company.

I imagine he was planning to filter between the lanes of stationary not moving traffic.

...obviously whilst moving no faster than the recommended 10mph above the speed of the rest of the traffic! Wink

(Hope the bike was OK)

You could have saved that, I would be thinking about a new front tyre or some emergency braking practice.

I'd attempt a claim however I'd probably have been more "in the left lane" than you were.

Why are you holding OP to a higher standard of driving than Vinny McVan?

Would have been better to have not locked the front brake in the first place.

But yes needs to practice braking. It's the initial 'grab' at the brakes that tends to lock up the front. You should lightly press the front brake and then progressively squeeze tighter.

You need to practice it until you don't need to think about so it's automatic because everything goes out the window in a panic situation.

But more important is to plan ahead. You shouldn't be getting into situations were you need to slam on the brakes.
