I have finally got a settlement I am happy with

it has taken just over 12 months

basically what happen was line of traffic on a straight road I filtered up it until I got to the front
van goes to turn into a pub carpark and a car pulled out into me

lost my job as was through an agency and couldn't work due to a broken leg

the case has gone 50/50 I am happy with this as I said at the time I shouldn't of gone round the van turning off

also settlement gives me £13 grand

Was wearing hiking boots and jeans

Was told proper biking boots wouldn't of helped as it was the dodgy landing that caused the break

Ouch! So is the settlement for pain or the bike or what? How do they work it out? And would you have got twice as much if someone else was 100% to blame?

Settlement was for pain and loss or earnings

Bike was sorted at te start was written off

And yes if it was his fault would of got 35 grand as they take off any benefits you receive

I'm gong to go pedant cos reasons. Would HAVE. There. Said it.

I'm surprised they didn't con neg harder on the lack of gear frankly. I seem to recall from earlier thread you'd said that it wasn't your greatest obs? If so - chalk to experience and one other thing is if you are working agencies and riding motorcycles without income protection maybe it's something to look into from a relative cost perspective.

Seeing as the only requisite by law is to wear a helmet how can they justify beating down the compensation claim for lack of extra, not legally required gear?

Do they do the same to car drivers who are not wearing full nomex race overalls and helmet?

Mmmm curious. I'll take a stab that you're no spring chicken, is this the case?

I only say as much because, not being one either, I have a titanium rod in my leg from my accident, whereas the much younger chap with a similar break had some sort of weird cage around his leg. So I'm just wondering if they just bolt the old ones together but let the young 'uns heal proper like...

Maybe they should add that "Driving a tank whilst wearing a suit of armour may help to protect you if you are involved in a collision".

36 but I landed stood up and the rolled three or four times to a stop atnearly 90 degrees to the ddirectio n I was traveling in

Had it on my life insurance to cover me but unfortunately I changed jobs and the company I went to only recruitedthrough the agency

Me, I'm hacked off by the amount of power that the anonymous writers of the Highway Code have to create liability where none existed.

Folk should be turning up to do their tests in a lid and a mankini and then seeing the DVSA in court when they get knocked back.

You don't have to wear an anorak with the hood up if rain is expected. But it's sensible to use the hood whenever it rains.
Now if you don't wear any clothing for inclement weather then who's fault is it?

You may not have a crash but if you are better prepared for a crash if/when it happens then good gear will almost always only add protection to your person. (And all the stats show most vehicle injury is with motorcycle/scooter-ists.)

Everyone who has completed CBT training has been advised of benefits of gear.

You shouldn't rely on legislation to guide your behaviour.
The law is there to keep people between the lines.

Can I point out that the ankle snapped above the boot
So motorcycle boots with a short ankle would still of had same problem but wouldn't of been as easy to remove
