Got into an accident earlier. I'm almost certain I wasn't at fault. The damage to my bike isn't too bad. The damage to his car involves a few dents and a few scratches. He'll say I was at fault. I'll get a call from my insurance in the morning and I'll tell them that I don't want to claim

So yeah I'm completely fine and my bike's brake lever is bent and there's a few scratches on the fairing along with a few more minor things. It runs well as I rode it home.

My camera was on but it wasn't recording. Embarassed

Currently got 1 years no claims and I'm still on L plates.

He's claiming against me. I've never been in a situation like this before.

What's next? (I assume he'll win and my premium will go sky high).

If you are certain the other dude is a tosser, phone your insurance company right now and tell them everything.

Do not say "i'm pretty sure it wasnt my fault"

Say, "I am certain I am not at fault"

Thanks, I'll be firm with them.

I did call them but the main office opens tomorrow at 8am. The guy I spoke to said they'll call me at ASAP after that time.

I'll provide the obligatory paint diagram soon.

3 people picked up my bike and asked if I was okay, none of them saw a thing. There didn't seem to be any cameras in the area either. Sad

Write down what happened and do it now

this is now, in your memory what happened, do not deviate from it.

If it comes down to your word vs his then liability may be split, for example 50/50 where the insurance split the claim between them.

as you say you're not at fault, your insurance should be looking for non-fault

Yeah I've got a document of my account on the situation. Got pictures of his car, the damage and his details.

I'll make it all extra clear to whoever I speak to and I'll record the calls.

One of my knees hurts a fair bit. I think that's it's going to cause great problems for the next 11 weeks. Laughing

If I simply fell off or knocked the bike over, then I'd probably just fix it myself and not bother claiming.

But if another vehicle is involved, I'd bung in a claim straightaway (whilst denying all liability). It's just too easy for the other party to lie and come out with all sorts of shite and it's better to let the insurance deal with that kind of nonsense.

I just don't need the aggro.

(Caveat: I'm old and farty and my insurance is dirt cheap, so I'm not going to dick about trying to save a year's NCB).

yep. i even queried it, and they said if i dont claim, i dont lose my no claims.

i thought it odd, but it all checked out come renewal time......

Can you tell us what happened?

Also, Cansa's advice is spot on. Don't be scared of the insurers, if you are unsure on anything they say, quesiton it, get them to explain everything. And what ever you do, do not accept the first offer.

Not much to add to what has already been said.

The insurers between them will decide who is liable, just contact your insurance tell them what happened, and let them argue over it.

Same happened with my son, he lost it on a corner on some loose chippings, ended up hitting a parked car. The car owners claimed on his insurance, but he didn't, he never lost his no claims either.

If you claim, or someone claims against you, you will always lose NCB (unless you have it protected)

If for example you had your bike stolen, informed your insurers, but then found it yourself and didn't make a claim, then you wouldn't lose NCB, because you've not cost the insurance company any money by putting in a claim. However they will then have on record that your bike is at an increased risk of theft and almost certainly raise your base premium (before NCB discount) at renewal time

Spoke to the insurance. They said it's likely to be my fault.

Here's what happened:

I was at a set of lights, and he was already making progress ahead of the lights. The lights went green, I was about 4 car lengths away from him, he did indicate to turn right, but he didn't turn, a considerable distance later he inches left (maybe slightly the line into the bus lane) and swings right without indicating. At this point, I'm on the horn and braking. He didn't clear my the lane and next thing you know I'm on top of his car. I wasn't able to swerve to the left because the gap between parked cars and his car was too small.

So to clear things up, I was behind him, caught up to him from a set of lights.

He stopped indicating after making no attempt to turn. A considerable distance later he dipped left then swerved right.

At the point his car was horizontal, I just couldn't stop, hence how I hit the side of his car in the rear area (above the wheel)

Wasn't overtaking, was just on the right side of the lane.

Paint diagram. Also, you see that gap behind the truck and the car behind it? That was roughly the size of the gap he used to pull that move.

I wasn't beside him, but behind him, approx 2 car lengths.
