Yes indeed - that's fine if it covers third party liability, I wasn't aware that it did. But then I've never needed to check it so I'm unaware that it does (home insurance that is). That's all I'm really interested in in this thread tbh. Causes etc are irrelevant. It's ability to recover fault free cost Smile


Mine doesn't. It covers certain things away from the house for loss or theft. It certainly doesn't cover me for third party injuries or damage on a push bike.

Would it not be the same if it was a car that you swerved to avoid. If they didn't come into contact with you it's your accident, your insurance stumps up.

You've not got third party liability cover on your home insurance? Shocked

I am quite stunned that the amount of people on here are against personal responsibility.

The amount of people walking at night on the road with no lights, no reflective clothing etc, etc. A real liability to themselves and dangerous to others yet that's fine, they are pedestrians.

If they use the roads they should have insurance at the very least. I have it for my dog, my daughter has it for her horses. Pedestrians should have it if they set foot on the roads.

Not if the guy you swerved to avoid wasn't a dick and admitted actually stopped to exchange details like the law says they must.

I think you'd struggle to get the insurance company of someone who has not touched you or your vehicle to pay up for anything that happened to it physically. In their eyes it would be your driving, your vehicle, your fault. Insurance companies are quite keen not to pay out even in the best circumstances. Where someone has not even touched you I doubt you'd have much luck.

Yep. I had this last year. A girl in her car didn't understand how traffic lights work (thought that each of the four roads joining a crossroads had a green one at a time, rather than opposites both getting green at the same time) so she turned across me to go to her right. I swerved to avoid and ended up sliding across tarmac, bounced and rolled. (Motor)Bike ok except a few scuffs. My body battered and bruised. Hurt (to the point of wanting to vomit) to bend leg for a few weeks. Police did nothing against her. It became my accident as I came off swerving to avoid slamming into side of her car.

If the car follows the law (ie stops and does the right thing) then yes they do pay out because they're insured. If they don't stop they're dicks and unfortunately you can't account for dicks. Dicks are why all of our insurance premiums are higher than they need to be.

And here you are defending them.

Either a) your insurance company didn't fight your case well enough, or b) the two insurance companies decided on the basis of the facts they were told.....that it was your fault.

You don't need the police to take action......that's why you pay your insurance premiums for!!!

Sympathy for what? You gotta fight your case if your innocent. Don't just accept what the insurance companies tell you. You're their customer and must do your bidding. If your innocent then fight!

On topic, no bikes shouldn't be banned, but compulsory insurance (third party) for riding on roads is a must. Even if it's through household insurance Smile

Yes indeed. Rare of course - but even today I watched a cyclist completely ignore the lights and go through (albeit gingerly) while I was sat waiting on red.

It's not on - they're road users and should abide the rules of the road. We have to.....and we have to pay for the privilege.

It's nothing to do with their eyes it's to do with where they believe fault would lie if the case goes to court.

Accidents like this happen all the time and claims are made against insurers where their drivers haven't physically contacted anything but their standard of driving caused an accident. It's not uncommon and where there's a potential legal liability the insurer will respond to defend or settle depending on the circumstances and evidence given
